The decision to isolate this procedure was taken Monday by Judge Shadije Grguri.
Agan and Shaban are accused of misusing their office.
Determination of the procedure for the accused has been made due to efficiency of the case, as due to the large number of accused persons, this subject is being challenged to be treated in practice by the tribunal.
After nearly nine months of the last hearing, the trial of former Health Minister Ferid Agan and other indictees has been resumed today in the case known as “Stanta”
In addition to former minister Agan and former Secretary Gani Shaban, indicted in this case, there have been 43 doctors and a nurse employed in public health institutions, as well as 13 people who have worked or worked in private health institutions, where a number of them are leaders or shareholders of these private health institutions.
In this case, charges against the accused are burdened by charges involving criminal acts, “misuse of official position or authority”, “bribery “, bribing”, “, irresponsible medical approach”, “anti-law of medical activity and pharmaceuticals <x10smangia by tax “
Although the indictment in this case was set up about a year and a half ago, the case “Stanta” still in the initial phase.
Former Health Minister Ferid Agani and 61 other indictees were found innocent in the initial review held on May 19th 2017.
Even accused Heidi Citaku, who had missed the initial review of May 19th, had been declared innocent at the May 25th 2017 session.
The same had demanded that the indictment be brought against them, but that their request had been rejected by the Constitutional Court in Pristina.
After the complaints of the accused, however, the case had been returned to the restoration of the Court of Appeals.
This, because as stated in the Appeals Act, the first-degree court had committed substantial violations of criminal procedure provisions when there was a hearing of the initial review without the presence of defenders, while for some others has held the initial review hearing without previously deciding on their requests for assigning defenders at public expense.
State prosecutor on June 15th 2016 had filed charges against former Health Minister Ferid Agani, MS Secretary-General Gani Shaban and 62 other persons for criminal acts “the abuse of official position or authority”, “bribery”, “bribery”, “irresponsive medical treatment”, “The anti-law against legal activity and pharmaceutical activity <x>) and <x>
Meanwhile, the prosecution had resigned from prosecution against cardiologist Africa Bekteshi, arguing that the same was wrongly involved in the indictment.
In this criminal case, investigations were initially conducted against 116 physical persons and 4 legal persons. But for 56 physical persons, no legal conditions have been met to be included in this indictment, so the same investigations have ceased.
The defense of the accused has raised numerous dilemmas about the legality of this indictment, which they claim, in addition to containing unacceptable evidence it has been illegally raised by chief state prosecutor Besim Kelmendi. According to the defence, the State Chief Prosecutor's Office has no competencies in establishing the charges, as has happened in this case. /Betiperity
