The Constitutional Court in Mitrovica has officially stopped the criminal procedure in the case, accused of war crimes against the civilian population, has been Oliver Ivanovic.
After his murder, this court of decision has dismissed the indictment against Ivanovic.
In this ruling, which has provided “Justice Vow (GEG) ”, it is said the indictment filed on August 12th 2014, as amended on December 7th 2017, brought against defendants Oliver Ivanovic, has been rejected because of the defendant's death.
In this decision, the history of this judgment, in which he had been sentenced to nine years in prison on January 21, 2016, but who later became retrial by the Court of Appeals.
“According to Article 358, paragraph 1.3 of the KPP, the Court will issue an act by which to reject the prosecution, if it has expired, any amnesty or pardon covers the act, or other circumstances prohibiting prosecution. The defendant's death, witnessed by his death certificate issued by the Ministry of Internal Affairs, in 26.01.2018, constitutes such a circumstance, which prohibits prosecution and concludes any criminal responsibility”, is said to be in this decision.
Ivanovic, who was chairman of the Civic Initiative “Leary, Democracy, Justice”, was killed on 16 January this year, in front of his party headquarters in northern Mitrovica, who was later buried in Belgrade.
