The Court of Appeals estimates that, based on the fact-finding situation, it results in the actions of the accused, D.N., who had taken them into the qualities of the mayor of the Partesh municipality, the elements of the criminal act are not fulfilled in question.
Therefore, given the actual criminal-juridical state proven in this criminal-juridical case, the Court of Appeals estimates that there is no need for further proceedings of new evidence, with the aim of confirming other facts, or for the pronunciation of existing facts, so in the presence of proven evidence for fair application of criminal law, this court brings another conclusion from those the court of the first degree.
