The Tirana Municipal Council, with only majority votes, has made the decision to fine those begging on the streets of the capital.

Article 7th 10th of the legal package criminalizes “Searching for donations in public environments and erasing or cleaning of car glass on terminal”, reports “Oranews”.

Tirana's municipality has approved the decision on Territorial Control and the definition of certain administrative offences and sanctions imposed on them.

Article 7

Anger Versus Public Space Rules

  1. Abandoning vehicles or other items on the streets, public environments or shared environments;
  2. Centination through making graphs or scriptures, pollution with different substances or scratching private and public buildings or other public objects, unless it is performed within artistic activities and with the approval of the responsible structure;
  3. Climbing, clinging or any other way, of various posters or posts in private and public buildings or other public objects without the approval of the responsible structure;
  4. Acting on actions or inactions, which endanger the life, health or property of others through the lack of safety of flower vases or any other item on windows, balconys, terraces, or any other part of public, joint or private environments;
  5. Using pyrotechnics or fireworks in every way that endangers health, life, property or environment, contrary to legislation on their use;
  6. Moving vehicles in watches and reserved places for pedestrians;
  7. The damage to public or common facilities, not stopping only on the steps of palaces, gardenes, benches, fountains, monuments, statues, and playgrounds;
  8. Setting up obstacles to any kind for speed limits of moving vehicles as well as building memorial objects along the road, without the approval of the responsible public body;
  9. Performing any activity in the vicinity and near the streets, risking road safety, outside the security standards set by the Road Code and without the approval of the responsible public body;
  10. The eating of public parking lots and places where parking is allowed in spaces near vehicle blocks with the aim of exposure/business or other business purposes;
  11. Biking by motor vehicles, bicycles in malls, parks or resorts for citizens in forbidden hours under rules set by Tirana City Hall and its responsible structures;
  12. As well as any other action or action described as administrative counter-invention, envisioned in the sublegal/normative acts approved by the municipal council or Tirana mayor.

Article 9

Administrators in the area of public calm and binding standards of coexistence

  1. As long as there are no criminal acts, there are administrative violations in the area of public calm and binding standards of coexistence:
  2. Cause of disturbing noises in public environments from bar-cafe music, restaurants and/or other service establishments, outside schedules set by relevant permits and legislation in force;
  3. Cause of disturbing noises of any kind in common residential environments;
  4. The causing of disturbing noises, in the inhabited areas by the trumpets, the loud music of the casthephones in the cars;

c. Cause of disturbing noises from work/building in public and private environments, carried out off schedules defined by good neighbourly rules or without the approval of the responsible public body;

  1. Waste burning or lighting fires in residential areas, garden or parks in undefined places for this purpose and without permission of the responsible structures;
  2. Using materials or various copyables, smoke, laser rays in open and closed public environments;
  3. Performing hippoism competitions in public environments in urban centres, parks and flowers in places not approved for this purpose by the responsible public body;
  4. Development of ball games or other games that affect security and tranquillity in vacation areas in public spaces or shared environments, except when these are conducted on responsible permits or in specific facilities designated for this purpose;
  5. As well as any other action or action described as counter-invention envisioned in the underground acts adopted by the municipal council or the mayor of Tirana.

Article 10

Administration Opposers Against Public Morality

  1. As long as they are not criminal acts, they constitute administrative wrongdoing in the field of public morality, these actions:
  2. Extinction/nudo in public environments;
  3. Urination, defiction or spit in public environments;
  4. Yelling with words and vulgar expressions or doing deeds with vulgar gestures in public environments;
  5. The actions or behaviors of any nature aimed at harassment, insults, or ridicule against people with limited abilities, elderly and vulnerable.
  6. Denial in open environments and in closed public environments when accompanied by actions that create concern for others;
  7. Researching charity in public environments and sweeping or cleaning car windows in traffic;
  8. As well as any other action or inaction described as countertaking envisioned in the sublegal acts approved by the municipal council or the mayor of Tirana.
  9. Subjects exercising their activities as nightclubs and disco clubs (stiptism), which are the source of sound and visual pollution for residents and the city of Tirana, are obliged to carry out their activity outside the perimeter assigned according to the map linked to this decision.

Article 11

Environmental Efficiency

  1. As long as there are no criminal acts, these actions constitute administrative wrongdoing in the field:
  2. The burning of urban waste in container, in the dump of waste collection ( VGM), in private and public territories, within the city's yellow line.
  3. The delivery of waste from the cleaning service to electric wells, water pipelines, water basins, etc.
  4. Handover of volume waste, construction waste, containers, or urban waste collection sites.
  5. Daily handover of urban waste to a volume of more than half the volume of a public container.
  6. Surrenders to containers or to tools used to collect waste, liquid waste, loose or unbounded bags, hot substances, heaters, dangerous for more hard remains or dead animals.
  7. Handover of waste from production, processing, treatment, etc. as well as unacceptable remains defined in the legislation in power, in public containers or in the country's stock collection ( VGM c.
  8. Throwing, pouring onto the sidewalks of water and debris different from cleaning or washing service premises, shops, etc.

Article 12

Administration Opposers in the Field of Public Infrastructure

As long as there are no criminal acts, there are administrative violations in the field of public infrastructure, these actions:

  1. Road network interference, like:
  2. Injury, crack, pollution and roadblock;
  3. Injuries, cracks, sidewalk pollution and body damage;
  4. Harassment, bottlelocks, kunets, cover-ring theft.
  5. Intervention on the road grid and phone network, such as:
  6. Unadopted ties in candelabras or the air grid;
  7. Wounding the pillars or the lights;
  8. Using pillars as support support for advertising, catching electrical, telephone, internet, etc.
  9. The damage to cable and airline bags from nearby works with or without permission and the removal of pillars.
  10. Interventions on the water network, like:

Article 13

  1. As long as they do not constitute a criminal offense, they constitute administrative wrongdoing by owners/guards in the area of implementing the binding animal/spending norms, in individual residential units, environments and public spaces, these actions:
  2. To ensure, that in joint environments, co-owners and public spaces, their animals/feet do not pose a danger to other humans or animals, by implementing the obligation:
  • The dog must be kept by the owner/guard, with a belt no longer than 1.5 (a point of five) meters.
  • Set up protective masks for dangerous race dogs: spic, hasky, Rotwailer, pittbul, dobermen, saw dog, pastor, Turkish canyon, boxer.
  • Avoid pollution of common environments, co-owners and public spaces from their animals/feet, and in case of pollution, clean up the environment after the defect.
  • To perform annual inoculation against rage.
  • They vaccinate and check near the doctor of the veterinarian clinic, animals/companion birds and luxury.
  • Respect the well-being of their animals and birds.
  • There is no rule, keeping in complete, permanent darkness and/or connected all the time of pets/house birds, companionship and luxury.
  • The persons who carry domestic, social or luxury animals, in individual residences or in collaborators in urbanised areas are obliged not to allow them to carry out pollution and cause noise, becoming a concern for other members of the community by violating the quiet joy of their property.
  • Keeping and/or increasing animals, livestock or birds of any kind, regardless of the number is prohibited within all residential units or shared property.
  • Keeping or circulation non-domited cattle, in public areas of urban centers such as horses, cows, sheep, goats, pigs, birds (pula) etc;

GJOBAT

Penal sanctions measures for administrative wrongdoing envisioned in this decision:

  4. For administrative violations in the environment, the Consumer Protection Agency near Tirana City Hall will impose fines:
  5. In the amount of 5,000 (five thousand) money, for the projected agreement at Article 1 and for every repeat case, this measure will double to the maximum value of 20,000 ($20000);
  6. At the rate of 20,000 ($000) for the consisting of violations envisioned at Article 2 11
  7. At the rate of 20,000 ($000), for consisting of violations envisioned at Article 3.
  8. For administrative violations in the field of public infrastructure, the Consumer Protection Agency imposes fines:
  • At the rate of 10,000 ($15,000), for the findings envisioned at Article 1, 12;
  • At the rate of 20,000 ($000), for the findings envisioned at points 2, 3 and 4 of Article 12;
  1. For administrative wrongdoing by owners/guards, in the area of implementing the binding rates of animal behaviour, in individual residential units, facilities in co-owners and public spaces, Consumer Protection Agency near Tirana City Hall will impose fines:
  2. In the amount of 1 000 (a thousand) money, for the findings envisioned in the letter “a” of Article 1 point 13, which doubles in the event of repeat violation within a 3 (three) monthly period by the owner of the animals/spenders;
  3. In the amount of 10 000 (ten thousand) money, for the findings envisioned in the letter “b” of Article 1 point 13, which will be doubled in the event of repeat violation by the owner of the animals/spenders;
  4. Despite projections of this article's 4th and 5th points, when municipal police find a high-profile counter-infraach in the field of public infrastructure, immediately imposes fine sentences according to this point's projections, and in each case announces the Consumer Protection Agency to calculate the damage and its reward from the counter taking. In this case, municipal police make a copy of the fine process available to the Consumer Protection Agency.
