Pristina's Constitutional Court has, recently, assigned the second time the detention measure to three Serbs arrested under suspicion of involvement in the murder of former Serbian Freedom Oliver Ivanovic.
During the day, the session was held with closed doors, unable to access the media and the public. Meanwhile, “Koha Ditore” has secured the court's decision in which new details and evidence were presented by the Special Prosecutor about this case, which is based on continuing the detention measure.
The suspects, Nedeljko Spasojevic, Marko Rosic and Dragisa Markovic, have acted as a criminal group, according to the prosecution. They are suspected of three criminal acts -- serious murder, discovery of official secrecy, and illegal possession.
“Consistent that the detention measure in the concrete case is most necessary, because defendants with their actions prove to be involved in the late man's murder, Oliver Ivanovic. Each of the defendants has contributed, carrying out duties or orders as a criminal group. For the defendant, Spasojevic, there is good-based doubt that he is involved in Ivanovic's murder. This is attested to by concrete evidence from the testimony of the anonymous witness AA1\x1>, says the court ruling, part of the case prosecutor Syla Hoxha's statement.
Suspect Spasojevic, according to the prosecutor, the night before the official murder of the Kosovo Police, along with a colleague, also a member of the Kosovo Police, sent with the official car “person, who still remains unidentified at the car ãoper Asra possibly, without license plates and glass buried in the parking spot, which the car had been parked for several days at that stop of”.
“This car, the unidentified person still took it and drove it out of there under police officials, now suspected, and the next day, or specifically, on January 6th of this year, was shot six times in the direction of the late Ivanovic. The same car, after the assassination, was found and burned in minutes at the same location where it was taken the previous night”, says the verdict.
According to the court, the involvement of the prime suspect among those arrested, Spasojevic in this criminal case is testified to by an anonymous witness, who has made identification through photographs.
As for the second suspects, Rosic, the prosecution has argued before the court that the same, according to the evidence they have provided, has “co-operated closely with people involved in this criminal group, following Ivanovic with his car, a black-coloured Jyp Santa Feú.
This is argued by photos the victim had on his phone, which were provided after examining his phone. Also found was a piece of paper marked by car plates in question”, the court ruling.
The third suspect, Markovic, according to the prosecution, has called a police official in Serbia, known as “Comadina”, after Ivanovic's assassination, and allegedly provided information from the site with authorization.
“... It is also suspected that the same from Serbia has ordered shelles removed from the scene. From there, he has also received a stir from police official Zarko Jovanovic, while Markovik leaves the site yet without completing the examination, even though he has been obliged to secure the scene, under official duty”, the decision is said.
The prosecution's evidence and reasoning is considered founded by the Court. Consequently, the three suspects have continued the detention measure until 23 December.
