The Constitutional Court in Pristina has turned the indictment back to the Special Prosecution for improvement and clarification of the Republic of Kosovo.

In the decision, which has secured the callo.com, Judge Nushe Kuka-Mecaj has given the Special Prosecutor 30 days to make the improvement and clarification of the indictment in the opposite case “The Venters” will be dismissed.

According to the Court, the indictment device should be clarified about how the accused's criminal conduct was carried out: Agim Ceku, Nuredin Lushtaku, Sadik Halijaga, Shumbin Demalijaj, Qele Gashi, Shukri Buja, Ahmet Daku, Rrustem Berisha, Faik Fazliu, Smajl Elezaj, Fadil Shudreaj and Xhavit Jashar.

According to the Court's decision, the prosecution should clarify whether action has been carried out in action or inaction.

“From the actual description of the criminal act results in that the word is of deliberate action committed, in contact and interaction by all defendants over a long period of time and from the circumstances spent in the indictment results in the increasing number of veterans caused by abusive action and not as a consequence of inaction because the failure to produce any other consequences, so the Prosecution should explain whether the work has been carried out by action or by non-action”, the Court ruling is said.

The court also has a unclear number of people who are allegedly profiting illegally, so it requires the Special Prosecutor to clarify the number of beneficiaries as to whether there are 20.238 or 15,115 persons who receive pensions from the Kosovo budget.

In addition, the indictment includes the prosecution's request for the suspension of the pension payment of 20,238 combat veterans until the end of the criminal procedure, and according to case judge Nushe Kuka-Mekaj, it would be better for the issue to be addressed in any other procedure the cause of procrastination to the limit of this trial.

Because it's a huge number of people, exceeding 20.999, it's clear that deciding on a wealth of judicial requirement along with criminal procedure would devalit the criminal case as a second-hand issue and put the procedure back to unlimited limits, so I consider such a matter to be addressed in any other procedure with the prosecutor's initiative “, the Court's decision said.

The reason for such procrastination, according to the Court, is that if the security measure is allowed, the decision must be sent to 20.238, veterans, who are affected by this measure and who have a right to a complaint, for which to place the college of the three judges, and given the large number of complaints to be filed, the judicial process would drag on indefinitely.

The Special Prosecutor of the Republic of Kosovo has filed charges against 12 defendants for the subject known in the opinion as “V ETERANIE” in the direction of criminal activity “misusing official position or authority”.

Also, in the indictment it has been proposed that the Court issue the measure to prevent the payment of legally acquired pensions as KLA veteran fighters until the end of the criminal procedure.

From the evidence provided so far has proven that illegal payments to KLA war veterans have been against them, the Republic of Kosovo budget has been damaged in many of the 68,153,533.14 euros.
