Although the Parliament's Headship failed to make a decision for the second time in absence of quorum, the introduction of the Enforcing of Specialised Chambers to the agenda of the Assembly's Headship, although legally necessary, is seen as serious and dangerous testing by analysts.

Today's failure to hold Headship in absentia, just like the December 22nd attempt to abolish what had been adopted two years ago, although it was named the most dangerous assembly for Kosovo and ousthic behind the internationals” by the ambassadors of Britain and the US, has not ended, because the request for the abolition of specials remains still part of the agenda at the next meeting.

The bid for abolition is seen as harmful to Kosovo by analysts.

Jehona Lushaku, legalising and at the UP's Political Sciences Department, says it is not serious that the same institutions that have approved the Special try to abolish it. But, she adds, the formation of specialised rooms has resulted from the United Nations Mission failure, U n NMIC, and the European Union, E ULEX, in Kosovo, because war crimes have been their competence and it has had to be found the possibility of bringing justice through 18 post-war years, if there have already been such cases.

If this initiative is approved in the Parliament, the Specialised Chambers will be able to be reformed by the United Nations. In this case, it will internationally be interpreted that the state of Kosovo was against justice and will need another international instance to bring justice. This, not only will harm our report with friendly states, but it will also damage our international image”, Lushaku told “Life in Kosovo”.

She says the legal base that was created with constitutional and specific law amendments adopted by the necessary majority in the Kosovo Assembly, now when these rooms have been consolidated and are starting to work is unserious to be taken by the same institutions by any other decision by the one they made themselves some time ago.
Any contesting of these chambers undermines the seriousness of Kosovo's highest state institutions, counters the conspiracy of these institutions in decision making, highlights the instrumentisation of state institutions by specific interests, and deeply fluctuates our state credibility by the international community. All these points affect the state of Kosovo, and the consistencys will be great. The consultations have warned ambassadors of Kosovo's friendly states, such as the United States, but also European states”, Lusak added.

Analyst Imer Mushkolaj said MPs could even abolish the Special according to their plans, which would lead to procrastinating the process of starting work by this court, but the same would be formed again by other international mechanisms.

“There are mechanisms that can be remade, which will be much more harmful that version that we have. Anyone who thinks with the abolition of the law can escape justice is wrong because sometimes he will face justice, only that the damage to the country will be enormous, a damage that has actually been caused even on December 22nd”, he said.

Mushkolaj believes leaders will continue to insist on breaking this court up, but said he does not trust the change in the stance of Parliament's head, Kadri Wessel.

I don't really believe him, even though he's definitely doing very well, because he's going to carry out international and other obligations, and I don't believe that his reaction has come too late, and the words he's saying are meant to be on December 22nd, to tell his deputies who have signed the signing for the abolition, and it's without reason and absurd that those MPs have gone to their head and without the approval of Wessel.

Mosskolaj says the chief parliament has practically not taken or taken actions to prevent the abolition, while <x0-decent is saying it is against abolishing and respecting international agreements”.

“The timing of the day shows that their purpose is not over and that they will bring this initiative to an end, it seems that despite very severe international reactions and reactions within the country, they have chosen to try to abolish the Special Court, but I don't know that this would be an evil act for our state, that with these things it is seen that those citizens' interests are much higher than the citizens who run”, he concluded.

Even yesterday, US Ambassador Greg Delaway said Kosovo's commitment to justice has been placed “under serious threat” with the initiative of 43 MPs, two of whom have withdrawn firms in the meantime.

This represents a terrible case where personal interests are above state. MPs who support this initiative will face consequences and they know this because we told them this”, Delawi said.

And AAK parliamentary group chief Ahmet Isufi said in front of the media he did not comment the ambassador's statements and that his party has not changed the position he had against this court.

Attempting to abolish Specials named it a criminal offence on the day of its departure, lawyer Dastid Pallaska.

The Special Court's imperilation to prevent the arrest and prosecution of certain rulers is a violation of justice, so it's a criminal offense. This means that the Special Court Attorney's Office has been possible since tonight under the law that is currently in force to announce the warrants and start prosecuting those who are aiming to obstruct justice! ”, he wrote.

While the assembly was officially on winter leave, its leader, Kadri Veseli, came out with a column where he said the Special Court would happen, which represents an contrary stance with that of his signatories who are demanding the abolition, which officially did not withdraw the signatures, despite the ambassadors of accredited QUINT in Kosovo and the EU have called on MPs to withdraw from the initiative to abolish it.

While Government chief Ramush Haradinaj said he has not changed his stance, saying they have voted against forming a special one and will vote for its abolition.

President Hashim Thaci, who once demanded from MPs that this court be voted and brought to public the debate on the subject, saying he does not expect justice from the Special, today says he will implement any decision MPs make, because, as he says, “deputs are capable of himself”.

Kosovo's Assembly of Headship of the Parliament failed for the second time today in absence of quorum and Parliament head Kadri Veseli said she will call the meeting next week.
