The Special Court will start working when the Special Prosecutor sends charges before this court. Still, there is no precise date for this to happen. Lawyer Tome Gashi has said about Indexline that the date when the first charges were to be filed before the Special Court, only special prosecutor David Schöndedjman.
According to him, the charges are ready, but it is a technical issue of when they will be handed over to the tribunal.

The trial has a lot of time, which several months are fully functional and all legal procedures have been completed, and it can always accept the first charges and begin to review those charges that will be submitted. The only person who knows when the Special Court will start the job is actually the Prosecutor's Chief Prosecutor, Schandymann, and we know on the basis of his statements that the charges are almost ready and there are technical issues when they will surrender. Of course it's expected very soon, but with a precise date no one has it except Chief Prosecutor”, he said.

Gashi has clarified that each person to whom an indictment is brought will be under pressure for at least 10 to 15 years. This, because prosecutors at any time have the right to accuse those people of alleged accusations.

However, Gashi has added that the delay in sending the indictment from the prosecution to the Court has nothing to do with the political situation, and that could never affect the court's work.

The court has previously been unfunctioned because of the procedures it has passed, but now it is ready, so whatever the situation is in Kosovo, it will not influence the work of the Court. Either way, we believe that we will soon have the first indictees there. We know that for anyone to file charges, that person will be under pressure for 1015 years, because the charges won't all rise at once, but prosecutors are right that at any time they accuse those they think have enough evidence of”, he stated.

A concrete answer on when the first indictments to the Special Court will be launched has not even provided the Special Prosecutor.

“should make it clear that the Special Prosecutor cannot comment on the status of investigations for legal, professional and ethical reasons”, he said.
