Fitim Jasanica and Gezim Ahmeti were witnesses invited by the prosecution in the trial for the murder of Naim Hajrizi, whom Gezim Retkoceri and Osman Spahiu are being tried.
Both witnesses testified to the meeting they had had with accused Guzim Retkoceri on the critical day.
Before questioning witnesses, the chairman of the court, Vesel Ismajli, announced the change of a body member with Judge Isuf Makolli.
State attorney and defence lawyers had no objections to the new composition of the court.
Later, witness Fitim Jasanica confessed to the meeting on a critical day with accused Guzim Retkoceri.
The meeting said it happened in the restaurant “River Petrol”, Lipjan-Sttime, about 0600 in the morning of the critical day.
“We have got coffee with Joy Retkocer and as far as I can remember there was Gezim Ahmeti”, the witness showed.
When asked by the prosecutor if there had been any social reports with accused Guzim Retkocer, Fittim Jasanica said she had only known him as an auto dealer but had not met him before the critical day.
Furthermore, in response to the prosecutor's questions and members of the court, the witness said he had later gone to the Automobile market in Prizren with his vehicle, Fiat Puntoı.
The second witness, Gezim Ahmeti, was asked if he had previously met accused Guzim Retkoceri. I know the father of Joy because he was a car dealer as a father, but I don't personally know joy”, the witness answered.
The prosecutor confronted the witness with a statement he had made in the police a few months after the assassination of Naim Hajriz, in which she had claimed that Gezim Retkocer knew and had more social reports. However, Gezim Ahmeti said that he had only known the accused's father, not him.
Furthermore, the prosecutor asked the witness if he remembered the meeting he had had with accused Guzim Retkoceri, the critical day, on the auto market in Prizren.
I met Retkocer in Prizren about 09 a.m. Wednesday, and we have conversation to exchange my two cars, with a 3-time party. But they don't have the stores with bong”, the witness responded.
And in the prosecutor's question, if she had met the accused at the restaurant “The Petrol” river, he responded by saying he had not met him at the restaurant because the house was headed directly to the auto market in Prizren.
Claiming to have contradictions between the two witnesses, the prosecutor has asked the court to face the testimony of two witnesses.
In the face of evidence, Fitim Jasanica reiterated as much as she remembered, at restaurant “The Petrol” River had drunk coffee with Guzim Retkocer and Gezim Ahmeti. However, Gezim Ahmeti responded by saying that he had not been drinking coffee that morning and that maybe Fitim Jasanica is confusing him with another day.
The Foundation Court in Pristina, in July 2015, had declared Guzim Retkocer and Osman Spahiun guilty of serving 30 years in prison for killing Naim Hajriz in April 2009.
But, after accepting the complaints of defenders and prosecutors, and after holding the trial hearing, the Appeals Court annulled the Constitutional Court's act in Pristina and overturned the case.
According to Appeals, the first degree court had substantial violations of the penal procedure's provisions, as well as the license of the court was not drafted as prescribed by the Penal Procedure Code.
