Legal Restriction of Technical Car Control

The Kosovar Competition Authority has found that the Law for Automedia (r. 05 L-123), estimates that Article 89 points 3 contradicts the Law on Protection of Competition (r. 03/L-229).
This law limits the delivery of services from the client's technical control centres within the municipality of the owner of the vehicle. The decision is expected to be made at the conference Authority's board meeting.
This authority is expected to recommend the Ministry of Infrastructure to begin with a change in Law No. 05 L-123 for Automakes, Article 89 points 3, on which consumer services are restricted within the municipality where the owner of the vehicle is home, respectively.
The reason for this authority is said to be that this provision of consumers is imposed on selecting services or products within a certain geographic area, restricts them and leads them to certain municipal or regional operators in case of providing services for technical control of vehicles.
From the point of view of competition, laws and regulations restricting the number of economic operators in the relevant market and limiting access to services are not in line with competition regulations and practices.
