Kosovo's Appeals Court has confirmed the Constitutional Court's act, thus proving the sentences of the accused in the case known as “Bavci”, where acts related to terrorism are charged with five persons.
News of the call.com confirmed by Albana Kelmendi, trusted lawyer Latif.
This year's July Act of the Pristina Constitutional Court convicted of pushing for the performance of faithful terrorist acts and Enis Latifin, Milam Hadziaj and Gazmend Halit, while Fehmi Musa was convicted of helping to promote the performance of these works.
Hadziaj, Haliti and Enis Latifi were sentenced to three and a half years in prison in July, while Besnik Latifi was sentenced to four years and six months in prison. Fehmi Musa was sentenced to three years in prison.
Three convicts were accused of preparing terrorist acts, a work that was requalified in a push for performing these works.
KA LLXO.com last month reported on special prosecutor Drita Hajdari's complaint to the Constitutional Court.
Prosecutor Hajdari in her complaint to the Court of Appeals claims that redefining the criminal act from preparing terrorist acts to promoting the conduct of terrorist acts was unstable.
These sentences pronounced by the Pristina Constitutional Court were easier compared to sentences pronounced in July 2016 when Besnik Latifi was sentenced to 13 years in prison, Gazmend Haliti to 12, Milazizim Hadziaj to 10 years and 3 months, Fehmi Musa to 4 years and Enis Latifi to 10 years in prison.
Relief sentences occurred after the Supreme Court of Kosovo retrialed the “Bavci” case, finding that the criminal work figure has not been met in preparation for terrorist acts.
According to the indictment, Besnik Latifi, Gazmend Haliti, Milazizim Hadziaj, Fehmi Musa and Enis Latifi, in July 2015 had gone to Badovci Lake near Pristina in order to record a propaganda video in which they planned to read the oath to the leader of the terrorist organisation “Islamic State”, known by Short I SIS.
The group, according to the prosecution, has aimed at publishing this video online in order to testify to the world to the extent of the so-called “Islamic State” in the Republic of Kosovo.
