Following the noise and postponement between Presidents Thaci and Vucic, the decree of 40 judges and 13 young prosecutors from the non-most community has finally occurred at a ceremony held at the Presidencys, attended by US Ambassador Delawi and EU representative to Kosovo Apostolova.

Thaci has told Serbian judges and prosecutors that on their shoulders it is a big responsibility they must bear.

I welcome your readiness to integrate into the Kosovo judiciary and work in accordance with Kosovo legislation. Likewise, I welcome your readiness that the prosecutor's post, respectively, will be exercised in honor, responsibility and impartiality, respecting professional ethics rules”, Thaci said.

Opposition clashes with Justice Minister for decreeing Serbian judges, prosecutors

Just hours after the decree of Serbian judges and prosecutors, the opposition has raised doubts beats the way they decree, saying they have information that this act has not been done in harmony with the country's Constitution.

Albulen Haxhiu, a member of the Commission for Legislation from Vetevendosje, at a meeting of this commission has said to have received information that the text of Serbian judges and prosecutors' oath has not been done as it does for all others.

It has presented a list of their names, which says they have been served by the Kosovo delegation from Serbia, and the same have been sworn in today.

But it has been flatly denied by Justice Minister Abelard Tahiri, who was invited to report to the commission on the case in question of c përgënjeshtruarast, has said that sovereignty has already been extended to the entire territory of the country.

From today, extending sovereignty in practical terms is taking place on the entire territory of Kosovo. These agreements are in full compliance with the Kosovo Constitution. Judges and prosecutors from the majority community have been decreed under Kosovo laws”, the minister said.

Why are documents for the Serbian judges and prosecutors' oath not given to MPs?

Concern for the decree made at the presidency today raised the next member of the commission, Arben Gashi from the LDK, who said it is disturbing that documents concerning the oath of Serbian judges and prosecutors are not given to MPs.

Everything that doesn't work as a state secret, we have a right to have”, Gashi said.

He has also asked whether there are other ethnicities in this composition, or they are all Serbs.

Meanwhile, Minister Tahiri said he did not deal with each of them, but said that according to the surnames he saw there are also Bosniaks, Roma, Ashkali and Turks.

Their “Trust is made as it was done with all others and there is no type of difference. If one of the judges conflicts with the justice system in Kosovo tomorrow, he will leave. The Disciplinary Prosecutor's Office deals with them”, Tahiri said.

While Sami Kurteshi from Vetevendosje said it is good to see the names and to be compared to the list MPs possess if those names really are set by Belgrade.

Tahiri said that if one considers the agreement unconstitutional could be addressed by the Constitutional Court.

The decree and oath of Serbian judges and prosecutors has welcomed the European Union, where in a statement issued on the EU official page by spokeswoman Maja Kocijanciq, their integration reportedly marks the implementation of the justice agreement reached in February 2015 under the EU-attensible dialogue.

“An integrated judicial representative of all communities in Kosovo is a critical element to ensure justice on behalf of the entire population. An integrated judiciary will allow a uniform implementation of Kosovo's law in all the Constitutional Courts of Kosovo and all Kosovo prosecutors“, the communiqué says.

While the Kosovo Judiciary Council (KGJK) has ruled the jurisdiction of judges and prosecutors of the community, it has called it an important step for Kosovo justice, which according to them marks the consolidation of a unitary justice system on the entire territory of the country.
