Constitution breaks Erion Veliaj's indictment of trial against SPAK file

The Constitutional Court did not pass the indictment of Tirana Mayor Erjon Veliaj at the plenary hearing, who complained of decision-making a preliminary judge who sent him to face the SPAK as a defendant in the foundation trial.
Insisting on incompatibility with the Constitution, the mayor attempted to abolish the decision on February 9th 2026 of the preliminary judge, who approved the SPAK's investigations and decided to continue the open trial of 30 indictees, among them and the local official. The constitutional judges praised the failure to pass the case at the plenary hearing.
As reported by Top Channel journalist Anila Hoxha, also, the mayor had requested in this court even the worthlessness of any subsequent hearing from the moment when the preliminary judge passed a trial body to the JKKO, processes that continue to be maintained only with the presence of his attorney, as Veliaj continues to insist on the equality of weapons, which is the exit of the cage and the landing in the hall alongside defence.
Even this point did not go to the plenary session, while other requests were linked to the competencies of the SPAK, such as Veliaj's attempt to abolish a provision of this law granting the special prosecutor authority to investigate, when there are reasonable allegations, colleagues and anti-corruption judges.
However, even this loss is expected to be exploited by Veliaj in the future, with access to the preliminary judgment not represented by his lawyers. At the same time, Veliaj's partial victory will also be used at the nearest time, taken by the Constitutional Court, which ordered the Supreme Court to review the Veliaj detention issue in relation to the task it holds as mayor and closure in the glass cage. / TCh
