In this decision, however, the panel of judges has found that the prosecution's first argument in the ongoing detention requirement is not fully supported. This is a “escape risk”. The court finds that although it cannot be fully expelled, the prosecution has managed enough to prove that there is a real and reliable possibility that Hashim Thaci will escape if released.
“Paneli finds that, while the risk of escape can never be fully ruled out, the panel considers that the Special Prosecutor has failed to verify its claim for a non-responsive “real opportunity for the accused to flee if released based on the phase of procedures”, the Special Court's document published on April 13th 2026.
However, the tribunal has continued detention of Hashim Thaci since it has found there is danger of obstructing the progress of special court procedures and conducting other works.
