Silently defended accused in case of explosion at “bar Sekiraqa” where two people died

In this case Beytullah Mehmeti, Luan Qerkeyni, Bekim Suma, Fadil Sadiku, Arbret Dalipi and Mehmet Mehmet Mehmeti are charged that on September 24th 2007, in co-ordination to Besnik Hasani, Shpend Qrim, and with the help of Afet Dalosh, a blaster was allegedly set up and broke up at the site of the “Sekiraqa”, on “Bill Clinton” in Pristina. As a result of this explosion had lost the life of N.M., and P.S., and several others had been injured, reports “The Law on Justice“, broadcast Periscope.

Similarly, at this hearing, Judge Alban Ajvazi suggested he received a parachute from the prosecutor of the case, Armend Hamiti, to read a few witness statements and evidence management proposals.

This prosecutor's proposal, the defence did not object, so they agreed that the evidence presented by the prosecution would be considered read.

Meanwhile, in terms of evidence linking with the other two indictees in this case, Besnik Hasani and Shpend Qerim, who have only been convicted, prosecutor Hamiti demanded that they be isolated from the subject papers and not be dealt with in this criminal case.

Otherwise, on July 29, 2016, the seven accused had been acquitted of charges of bombing at the “locale. But this case was turned into retrial in April 2017 by the Court of Appeals, following the prosecution's complaint that the Constitutional Court's decision in Pristina was not fair. The findings of the first-degree court that the non-intelligence of excusing evidence are reasons for the prosecution's refusal, according to Apel, this circumstance provides no reason for the prosecution's refusal.

The act, set up by the Special Prosecutor of the Republic of Kosovo on August 22, 2014, exactly by EULEX prosecutor Maria Bamieh, charges Bejtullah Mehmeti, Luan Qerkinin, Bekim Summan, Fadil Sadik, Afet Dillosin, Arbresh Dalipi and Mehmet Mehmetin.

According to the indictment, this happened by placing and breaking an improvised explosive device on the ground floor in the bar object “Sekiraqa”, on “Bill Clinton” in Pristina.

This charges them with committing criminal work “grave murder” in violation of provisions 23 and 147, par.4, 9 and 11 of the Kosovo Criminal Code.

It says that after a long history of police violence in Ferizaj, the officers of the ROSU Unit and Enver Seker Sequiraces, and after the murder of policeman Triumf Riza, who in the indictment reportedly believed that “was ordered by Enver Sekiraqa<1>, Ferizaj Police along with the ROSU police planned revenge against Sequiras, blowing up his local bomb in Pristina. It was reportedly located in a populated residential area that was full of bars and restaurants. The bomb, on the other hand, was reportedly deployed in the month of Ramadan on September 24, 2007, when the locals were open to people who were syffyring. The size of the bomb, the site of its deployment and time of the explosion, reportedly meant that the defendants were meant to kill.

At the second point of the indictment, Beytullah Mehmeti, Luan Qerkini, Bekim Suma, Fadil Sadiku, Arbresh Dalpipi and Mehmet Mehmet, co-chaired with each other and also at the helm with now convicts for the same criminal work, loyal Hasani and Shpend Qrim, as well as with the help of Afet Dalosh, postcurulite revenge or other low motives and deliberately risking the lives of one or more people, taking immediate action to be deprived of life. This charges them with committing criminal work “severe attempted murder” in violation of nines 20, 23 and 147, par.4, 9 and 11 of the Criminal Code.

Always according to the indictment, the size of the bomb, the site of its location, and the time of the explosion, meant that the suspects were meant to kill, and that happened after two people were killed, and tried to kill the other 11 people.

The third point of the indictment, charges accused Bejtullah Mehmeti, Luan Qerkini, Bekim Suma, Fadil Sadiku, Arbresh Dalpi and Mehmet Mehmeti, that, in co-ordination with now convicts for this faithful Hasani and Shpend Qerimi, as well as with the help of Afett Dalosh, caused the general risk of human life, breaking up an improvised explosive device, located on the floor and a building on the <x0BEII Clinton> in Pristina, causing the death of two persons, causing serious bodily injuries, as well as well as a result of several property in Pristina and commercial activities.

By that, they are accused of committing criminal work “The cause of general risk” with violations of provisions 23 and 291, par.1 and 5 of the Kosovo Criminal Code.

Always according to the indictment, Ferizaj Police, along with ROSU Unit police officers, executed a plan and met at the Deles Farm in Racaj the day before the critical day (September 23rd 2007), reportedly two people were sent to pick up the device, anti-tank mines and two weapons.

The incident says the plan was to blow up the bar “Sekiraqa” After returning, it is said that the accused Dalipi and the two accused Mehmet had been instructed what to do, while Dalloshi reportedly let the police execute their plan and had been received at a local Kacanik. Both police cars were reportedly secured by accused Suma and Sadiku, and the license plate was hidden from accused Bejtullah.

After that, members of the group are said to leave by car for Pristina to execute the plan. The bomb was placed at the local area about 2:10 on the morning of September 24, 2007, where two people were killed and 11 others hurt.

Medical history:

The indictment says the defendants were investigated in 2007 after allegedly involved in the explosion at the “bar. Sekiraqa” From witness statements at the scene in 2007, it is reportedly clear that in the case eight police officers were involved in two police vehicles.

At the end of the investigation, an indictment was filed against Besnik Hasani, Shpend Qreim and N.C., due to general danger, serious murder and attempted murder. Luan Kerkin, Beytullah Mehmeti, Fadil Sadiku and Bekim Sum were not accused of not having enough evidence.

The first instance was established on August 12th 2008, the indictment was declared on September 22nd 2009, where Hasan and Qerimi were sentenced to 25 years in prison, while N.C. was acquitted. The decision was made firm on May 25th 2012.

The investigation and the indictment are said to have been initiated by new evidence and evidence that has come to light from the decision regarding the first indictment.
