Kurti writes on the request that the provisional move be imposed also on the fact that Osmani subsequently held a consultative meeting with political parties regarding the date of extraordinary elections.
The following “, the motion front-runner explains that: “The introduction of the provisional measure is also imposed by another circumstance of particular constitutional weight. After the release of the Conflicting Decree No. 24/2026, on the same day, March 6th 2026, the president of the Republic of Kosovo has taken the first steps to materialise its judicial effects, respectively, by calling political parties to a consultative meeting regarding the appointment of the date of extraordinary” elections, he writes in the motion sent to the Court.
Kurti says without setting a temporary measure there would be immediate and real “risk for her to announce the new elections.
“If the controversial decree remains in force, elections should be held within the constitutional deadline of forty-five (45) days, thus turning this act into an irreversible institutional process in practice. Under these circumstances, the constitutional danger is no longer hypothetical but immediate and real. It consists of creating an actual situation that, even in the event of the court's subsequent unconstitutional findings, would be extremely difficult to return to the previous judicial situation”, Kurti writes at the request.
The Constitutional Court imposed temporary measures that prevented the president and the Parliament from taking any action until the end of this month.
