On November 8th, 2022, Kosovo Assembly deputies adopted the Law for Provisional Measures of Basic Products, with 64 votes per, none against and abstention.

This law envisioned the setting of a ceiling price for some important daily products, such as cereals, bread, flour, rice, food oils, and personal hygiene products, in special cases of market destabilisation.

However, this decision faced strong opposition from opposition MPs, who viewed the law as unconstitutional and contrary to the principles of the free market economy.

MPs from the Parliamentary Group of the Democratic League of Kosovo (LDK), Driton Selmanaj and Besian Mustafa, handed over the law to the Constitutional Court for Review.

In 2023, the Constitutional Court announced the Law on Prices of Invaluable Wire, arguing it was not in accordance with the Constitution of Kosovo, reports Telegraph, broadcast Periscope.

In its reasoning, the Court stressed that the move cannot be in line with the fundamental principles of market functioning and freedom of competition, which are guaranteed by the country's Constitution.

According to the government, this law was designed to prevent unreasonable increases in basic prices and to protect consumers, taking into account numerous complaints from citizens about the immediate increase in basic product prices.

The law envisioned that in the event of market destabilisation, prices of important products under control could be intervened, guaranteeing economic stability.

After declaring the worthlessness of the law by the Constitutional Court, the Government of Kosovo took new steps to address the need to protect consumers and maintain economic balance in the event of crises.

On February 2026, Minister of Industry, Trade, Trade and Innovation Mimoza Kusari-Lila signed the initiative for launching procedures for a new draft law on the provisional measures of basic products in cases of economic crises, which still includes the forecast of ceiling prices.

Minister Kusari-Lila stressed the importance of this bill, viewing it as a necessary step to protect consumers and guarantee stability in the market. She stressed that the new law would create a legal basis for quick and fair intervention in the event of sudden price hikes, shortages of products and supply disorders.

The purpose of this bill is, not arbitrary intervention in the market, but the protection of citizens from abuse and speculation in times of crisis,” said Kusari-Lila. She also stressed that this bill was drafted taking into account remarks from the 2023 Constitutional Court, and that it would provide a stronger and sustainable legal framework to enable fair and balanced intervention in the event of economic crises. /Periscope
