What we are seeing is not random speech, but clear effort by the Specialised Chambers for “damage control” to their heavy image, following successive violations that they have committed to the fundamental rights of the accused and to the constitutional order of the Republic of Kosovo.

Instead of dealing with propaganda and public image management campaigns, the Special Court must improve its credibility by respecting the Constitution, the laws of the Republic of Kosovo, and international justice standards.

These scenes remind us that, in a similar way, power bodies in the former Yugoslavia once acted, respectively, the Communist League and the Socialist League, which after demonstrations of the 1981 student movement organised meetings in villages and collective labour, in order to punish the organisers of these demonstrations and political and psychological preparation of the people to accept as well as the dracronic sentences that then power was preparing to pronounce Albanian youth. This popular approach of propaganda and institutional pressure does not serve justice, but is imposing a prepared narrative.

The main violations that have seriously damaged the credibility of the Special Court are:

1. The violation of the principle of equality before the law, prosecuting only one party, the KLA's liberation fight, while Serbian crimes remain unpunished.

2. The constant denial of temporary release, even under humanitarian circumstances, contrary to European practice and the principle of proportionality.

3. Unjustifiable length of detention, without final verdicts, transforming detention into a preliminary sentence.

4. Decent of the human dignity of the detainees, through restrictive conditions and treatment that fail to respond to the standards of the European Convention on Human Rights.

5. The lack of transparency and public accountability, including refusal to address the concerns of institutions and veterans' organisations.

6. Indirect interventions in sensitive social areas, such as education, no institutional authorisation and no public debate, which raises serious doubts about influence and propaganda.
