In demand for Krasniqi similar to Selimi, the prosecution says the outcome of their presentation of evidence increases the risk of obstructing justice and committing other crimes.
In addition, the ZPS has said it also justifys reviewing the risk of escape in decisions on continuing detention. The same is highlighted in the decision for Rexhep Selim.
According to them, there continue to be doubts based on the fact that Jakup Krasniqi has committed one or more of the crimes that fall on the DHSK jurisdiction. Even the prosecution says this suspicion has been reinforced by SPS evidence already involved in the trial file.
They say that, the fact that Krasniqi and Selimi now have special knowledge of the case and the evidence against him increases the risk he can commit other crimes, including against witnesses who have given or can give evidence in the case and/or can be presented before this panel in future phases of procedures.
Moreover, Selimi is already aware of the identity of all SPS witnesses and their evidence. The outcome of the SPS issue does not diminish the risk of obstruction, but increases it, as the accused already has full knowledge of the content of the issue against him. As highlighted by the Judicial Chamber, there is the danger that the interventions in order to ensure the withdrawal of evidence and/or to discourage future witnesses from giving evidence could hinder the progress of the procedure. Furthermore, it is possible that witnesses will be called back, making them vulnerable to attempts at intervention”, the Prosecutor's request for Selimi says.
In addition to risk of escape and obstructing procedures, the prosecution has said the measures imposed on detention facilities have provided guarantees against unmonitored visits and communications as measures to downplay relevant risks.
They say detention remains proportional and reasonable, especially that procedures have already progressed.
Otherwise, the prosecution on April 15th 2025 has announced that it has completed presenting evidence in this case.
The Specialised Prosecutor's Office, on September 30th 2022, has handed over the confirmed amended indictment against Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, which consists of ten points on charges, where the latter are charged with war crimes and crimes against humanity.
