According to the decision, issued on December 23, 2024, inspection has revealed that in college venues, namely at lecture halls and toilets, near sinks respectively, surveillance cameras were located, contrary to the Law on Protection of Personal Data.
In this case, the College has provided an explanation.
As a result, the institution has been ordered to remove the monitoring system from these spaces and ensure that the use of cameras is compatible with the legal provisions that are applicable.
The pronounced “Gjoba must be paid within 30 days from the entry into force of this decision, while disregarding the deadlines will bring further measures”, It says the AIP decision.
AIP argument on fine
The agency has given the reasoning about the fine pronounced against the Universum College in Ferizaj due to the deployment of surveillance cameras in prohibited spaces, such as lecture halls and toilets.
The decision states that the agency received a complaint in 29,11,2024, claiming that at lower high school in Ferizaj (in the context of Universum College) there were cameras in legal rooms and toilets.
An official inspection was then conducted in 10,12,2024, where it was confirmed that they were installed. 25 cameras, of which 14 were functional.
According to them, the cameras were located without notice and in areas where privacy protection is guaranteed by law.
“The law stipulates that setting cameras should only be made for security and in line with the legal provisions”.
After these findings, the AIP pronounced a fine of 8,000 euros, naming both serious and harmful violations for the privacy of students and staff.
In its analysis, the Agency refers to the Constitution of Kosovo and the European Convention on Human Rights, which guarantees individuals' privacy. Also mentioned are precedents by the European Court of Human Rights that have established that classroom and toilet observation is a violation of privacy
Consequently, the College has been ordered to immediately remove cameras from the halls and toilets, and to observe the legal laws for camera surveillance.
