10 years in prison and 30 thousand euros in fines against three accused of transporting and selling narcotics

The Constitutional Court in Pristina has declared the sentence against Mejaid Qerim, Fehmi Mustaf and Djulin Radojas, convicting them of criminal work “Blerja, possession, distribution and unauthorised selling of narcotics, psychotropic and analogue”. The indictment was announced Monday by the court court with Judge Lutfi Shala and members: Cameron Krasniqi and Valon Kurtaj, reports “The Justice Trust“.

Under the verdict, accused Qerim and Mustafa were sentenced to 4 years in prison and 10,000 euros in fines. And Radoja with two years in prison and 10,000 euros in fines.

The promotion was acquitted of criminal activity “The attack on the official person”, as according to the Court, this criminal offense is consumed in criminal acts by Article 267, for which he was sentenced to prison.

The court said the accused, if not able to pay the fine sentence, was replaced with prison - where, for a day in prison, 20 euros was accounted for by fine sentences.

And according to the verdict, the seized narcotic, after the full might of the act, is sent to destruction.

The disgruntled side has the right to a complaint in the 30-day term after they accept the written decision.

Only the accused Radoja was present in the statement of the indictment, but the other two were missing, including the special prosecutor.

Otherwise, in this case, 11 people are charged, but the procedure has been set aside for those charged with Qerim, Mustafa and Radoja.

According to the Pristina Foundation Court's decision, dated November 22nd 2023, accused Mejaid Qerim, Fehmi Mustafa and Djulin Radoja have been convicted, so that the government has been sentenced to 4 years and 6 months in prison and 10,000 euros in fines. Mustafa has been sentenced to 5 years and 10 thousand euros in fines, while Radoja has been sentenced to 2 years and 6 months and 10,000 euros in fines.

However, the Court of Appeals with the verdict of May 30th, 2024, has turned the case into retrial, since according to Apelti the indictment was involved in essential violations of the KPPRK provisions, which have also conditioned its annulment, since the fundamental issues with which the accused have been convicted have not been fully granted.

According to the Special Prosecutor's Act, founded on December 27, 2022, Mejaid Qerim, Fehmi Mustafa, Genan Shala, Gazmend Aliu, Bardil Rumija, Namzi Mzio, Djulin Radoja, Suad Buliq, Fatlum Abdullah, lives Aliu and Venhar Pajaziti, are charged with distributing drugs in co-operation and transporting up to 91kg of marijuana.

According to the first device of the indictment, Mejaid Qerim, along with Fehmi Mustafen, were charged with selling illegal narcotics during the year 2021 to February 9, 2022.

In the indictment, the accused had initially planned that drugs be transported to Serbia through the company's buses “Deda Reisen”, the property of Fehmi Mustaf. So on February 9, 2022, the Qarim in his vehicle charged narcotics and left for the village of Konushevc of Podujevo, where he met with Fehmi Mustaf. In the courtyard of the latter's home, where the transportation buses were located, says that when the dog pulled out the bags to put them on the bus, he noticed a wiretap that was being observed, he turned the bags into vehicles and tried to leave. The police tried to catch him, but he managed to escape, leaving his car and narcotics there. Thus, the transport of narcotics to Serbia was hampered by police intervention.

With these actions, they are accused of committing criminal work “Blerja, possession, distribution and unauthorized selling of narcotics, psychotrope and analogue”, from Article 267, pregarfi 2 related to paragraph 3, regarding Article 31, as well as with respect to Article 275, paragraph 1, points 1.3 and 1.9 of the Penal Code.

On the other hand, according to the second device, Mejaid Qerimi was charged that on February 9, 2022, at around 9: 00 p.m., in the village of Konushevc, the Podujevo municipality, aimed at avoiding arrest, attacked police officer Arben Elshani, the moment he gave him a sign to stop the vehicle, the accused continued the move intentionally, striking him with his car, with which he caused bodily injuries.

With that, Qerim was accused of committing criminal work “Attack on the official person”, from Article 402, paragraph 2 concerning paragraph 1 of the Penal Code.

On the other hand, accused Genan Shala, under the third device of the indictment, is charged that on March 11, 2022, around 21:50, in the village of Brezone, the Dragas municipality, possessed at his 399.24 grams of marijuana, an electronic weight in narcotics, 85 empty nylon bags, and a plastic conversation.

With this, he is accused of committing criminal work “Bler, possession, distribution and unauthorized selling of narcotics, psychotrope and analogue”, from Article 267, Criminal Code 1 paragarf.

While, according to the fourth prosecution device, Shala is accused of helping accused Mejaid Qerimi avoid arrest by sending financial means to hide and help secure illegal transportation from Serbia to Kosovo. He was detained by Kosovo Police on March 11th 2022, transporting Mejaid Qerim with his vehicle.

For these actions, Shala is accused of committing criminal work “The law of assisting perpetrators following the conduct of criminal work” paragraph 2, points 2.8 concerning paragraph 1 of the Criminal Code.

On the move, according to the fifth device of the indictment, accused Gazmend Aliu, Djulin Radoja, Suad Bulqi, Bardil Rumija and Nazim Mziu are charged that by co-operating with each other, they deliberately claimed narcotics, so that Ali and Rudo continued throughout 2022 they have distributed and transported narcotic substanaca, in the way Rudo sent with the intention of selling substant narcotics Ali via the accused Rumi and Bulq.

The accused Rumija, on the other hand, is accused of transporting narcotics from Albania to Kosovo by car for sale, in that way, the same way on April 2022, passed the border point in Vmica. After crossing the border point, he met with Nazim Mziun in the village of Vaganica, Mitrovica municipality, where they jointly went to Nazim Mziut's garage, where narcotics of 10.583kg, hiding in the modified vehicle bunker, were divided into 15 packages. In the same garage, Nazim Mziu also owned 18,905kg of narcotics destined for sale and transport, which was seized by police.

The Actakuz says that the same day, accused Suad Bulic, is accused of transporting another amount of narcotics from Albania to Kosovo by car, where during 05:40, he crossed the border to Vmica, but in Fushe-Kosovo was banned by police. During the search on the vehicle's modified bunker, 10,072kg of marijuana were found.

In this regard, accused Aliu, Rudo, Bulqiqi, Rumija and Mziu are charged with criminal work “Blerja, possession, distribution and unauthorised selling of narcotics, psychotrope and analogic substances”, by Article 267, pregar 2 over paragraph 1 over Article 31 of the Penal Code.

While, according to the sixth device, accused Gazmend Aliu is charged that on September 16, 2022, in the village of Mazzit, the Obilic municipality, he distributed narcotic substances without authorization in order to sell them. Where, according to the prosecution, about 10:00 p.m. at his house, he offered the sale to 205 g of narcotics, divided into two sections (102 g and 103 g), accused Venhar Pajaziti and Fatlum Abdullah.

Aliu is accused of having committed criminal work “Bler, possession, distribution and unauthorized selling of narcotics, psychotrope and analogue”, from Article 267, pregarfi 2 over paragraph 1 of the Penal Code.

On the other hand, according to the seventh device of the prosecution, accused Venhar Pajaziti and Fatlum Abdullah are charged with going to Gazmend Ali's house, who owned narcotics for sale, buying 205 gm of marijuana (divided at 102 g and 103 g) for 400 euros.

In this regard, Pajaziti and Abdullah are accused of carrying out the “Bleria, possession, distribution and unauthorized selling of narcotics, psychotrope and analogue”, from Article 267, paragraph 1 connected to Article 31 of the Penal Code.

And, according to the eighth device of the prosecution, the defendant lives Aliu, has been charged since September 16, 2022, in the village of Mazzi, the Obilic municipality, with the intent of trading narcotics. According to the indictment, during his police house raid, the same have been found and sequestrar 151 grams of marijuana, 3 grams of cocaine, an electronic scale, 4 pipes, 3 marijuana mills, several nylon bags, a metal rod and 840 euros in cash. In a relief home, 17 grams of marijuana were found.

In these actions, the same is accused of “Bler, possession, distribution and unauthorized selling of narcotics, psychotrope and analogue”, by Article 267, pregarfi 2 concerning paragraph 1 of the Penal Code. /Periscope/
