Court: Suspect of injury in Pec had planned escape by leaving the car on fire.

One of the wounded is Basri Gashi, who is charged in the case of Hoxhaj's brother, who on 17 October after the plea was released from the detention measure. The other wounded is A.U., who had gone to take Gashi and the others who had been released from custody.

“Justice Vow” has secured the verdict with which suspect Hoxhaj was given custody. According to the decision, defendants Mahmut Hoxhaj during the detention measure are allowed to stay at the General Hospital in Pec, where he is now committed until his recovery according to the recommendations of doctors relevant under the supervision of security officials at the Centre of Pre-burg. After completing the defendant's recovery, he is sent to the Centre for Pre-prisonment.

At the hearing session, which was held at the Pec Hospital, state prosecutor Ersan Qavolli was present, defendant Mahmut Hoxhaj and his lawyer, Fanol Krasniqi -- under authorisation.

According to the ruling, prosecutor Qavolli has stated there is doubt based that defendant Hoxhaj committed criminal acts “grave murder remaining in the attempted” and “Abnegation”.

It says the prosecutor has stated that conditions for the appointment of the detention measure have been met. He has said that according to the process of questioning injured Agron Gashi at the police station, he has declared he has been in prison because of problems with the defendant now and suspicion of killing his brother.

The “in prison was due to problems with Mahmut Hoxhaj and the suspicion of killing his brother. The same claims that the critical day has been released by the court and the A.U., has gone to collect and have just started being attacked with a gun in which A., and Basriu was wounded. Meanwhile, the injured Bahri Gashi, said at the police station, said the defendant fired in their direction and wounded Basri Gashi and A.U. Bahriu also said he was in prison under suspicion of killing Hoxhaj's brother.

Mahmaut Hoxhaj has been shot towards me and injured Basri Gashi and A.U. The same adds that he was in prison as suspected of killing defendant Mahmut Hoxha's brother, while on the 1710.2025 date he was released along with Basri Gashi and Agron Gashi. Had police not been involved, Mahmut had killed us all”, Basri Gashi was quoted as saying.

Likewise, Qavolli has mentioned that two long arms, two short arms and several bullets have been seized. He has said that from the Police database, Mahmut Hoxhaj is involved in 43 criminal cases, of which as suspects in 25 different cases.

Always under the decision, the prosecutor has stressed that the defendant has been detained in a phalanx by Kosovo Police during the criminal conduct and his car had left him on fire with a view to escape, but has fortunately been arrested due to the good work of police officials. So, according to the prosecutor, with his release, he can escape and prevent the normal course of criminal procedure.

The prosecutor has argued that there is a real danger for the defendant to influence the injured and witnesses, especially his family members who have been critical of the Constitutional Court in Pec, all in order to prepare protection for him.

“... The defendant had waited for the victims until they left the detention center, had fired at them with two long guns, even after the car crashed in the siege, he had still continued for the shooting, and had also taken the gun from the ground to continue shooting but was encountered in the Kosovo Police, which tells of his purpose and determination in carrying out the criminal work” was quoted as declaring the prosecutor.

According to the prosecutor, there is a danger that when the defendant is released, he can complete the task of trying. He has said the alternative measures would be insufficient for the security of defendants in criminal procedure.

On the other hand, defendant Hoxhaj's defender, lawyer Fanol Krasniqi, has rejected the prosecution's request for the detention assignment. He said defendant Hoxhaj “killed” when he was killed in 2022, during the trial that took place in the brother's case, and when on October 17th, the Court decided to release the four accused from custody.

According to him, the defendant on a critical day has been found in a severe psychological situation, with injustices committed during the year 2022 to the proclamation of judgment.

The lawyer said the Court and Prosecutorship in Pec should be excluded from the case because the work was carried out near the tribunal's facility. He said he reserves the right to submit a written request except for the Court and Prosecutorship in Pec from this subject.

defendant Mahmut Hoxhaj said he agrees with his lawyer's statement and rejected the request for the detention assignment. I agree with my protector's statement, I object to the request for the detention measure against me, and I have nothing else to add to”, the defendant Hoxhaj was quoted as declaring.

Court's Reason:

The preliminary procedure judge found that the state prosecutor's request is based. According to the Court, there is the danger of escaping with the release of the defendant in view of the burden of the criminal act he is suspected of.

Similarly, the Court has estimated that with the release of the defendant to freedom, it can contribute to the injured and witnesses who will be questioned during the investigative phase in the prosecution.

The court has also estimated that there is a danger of repeating criminal acts in case Hoxhaj is released, given the fact that the same was waiting for the victims until they left the detention centre and shot in their direction with two long arms and continued shooting even after the car crashed in the fence.

Also taken on the basis of the fact that Mahmut Hoxhaj, from the Kosovo Police database, turns out to be involved in 43 criminal cases, of which as suspects in 25 different cases.

The Foundation Court in Pec has estimated that alternative measures do not provide enough security for the normal and successful development of the criminal procedure, and there is not enough security to avoid the danger of escape, the impact on damage, witnesses and repetition of criminal work. So he estimated that in this case the detention measure is necessary for normal and unhindered development of criminal procedure. Otherwise, the “Justice Trust” has published the moment when Hoxhaj had fired both of the injured now, where it appears there were two Kalashnikovs with him. Preliminary investigations indicate that the suspect had been party to a trial that had ended a few minutes earlier with the release of the other side. Immediately after the conviction was declared, Hoxhaj allegedly appeared in the parking lot behind the tribunal, where he waited for the victims and fired at them with two AK-47-type automatic weapons.

Suspect Hoxhaj, who is the brother of the slain in Volljaka, F.H., is suspected of having injured two people in retaliation after the Constitutional Court in Pec pronounced 44 years in prison for the five accused in the 2022 murder.

The “Justice Vow” has provided the recording of the court's declaration hearing, where honour Gashi has been sentenced to 28 years in prison, while Basri, Agron, Ardi and Bahri Gashi have been sentenced to 4 years each for the murder of the F.H. In all, 44 years in prison have been pronounced in the retrial, since 84 years of imprisonment had been pronounced in the first trial.

Under the trial, the accused, honour Gashi, has continued the detention measure, but no longer than the stated sentence. The other four have been cut short.

Of the shootings, two people were severely injured and originally sent to Pec General Hospital, where they received urgent treatment. One of them has been transferred to KKUK in Pristina for further treatment due to serious chest injuries.

At the scene, regional investigation units have seized two long AK-47 weapons, two pistols, 149 rounds and 16 shellings, while other material evidence is expected to be sent for ballistic expertise. /Periscope/
