Three KKUK IT officials acquitted of corruption

The Constitutional Court in Pristina has declared a free trial against three IT officials of the University Clinical Centre of Kosovo (QKUK), Faton Hayzeraj, Leutrim Jahja and Ylber Krasniqi, who were accused of misusing the official position, in connection with the case of assembly of cameras at QKUKU. The trial in question was proclaimed Tuesday by the chairman of the court, Judge Naser Foniqi, reports “Betim for justice”.
According to this indictment, it has not been proved that the accused committed the criminal act that was placed on him.
Judge Foniqi also pointed out that the court has come to the conclusion that the accused have by no means benefited or hurt themselves.
“We have concluded that the contract, as it was released between the CKUK and the economic subject, had no changes, no meeting the contract, the work was carried out by 44 days late according to the evidence that we have, which at the time of the case was reasonable, because all institutions at the time have had difficulty, even having the decisions of the Government not to work on me except on extraordinary”, Judge Foniqi said.
Also, the judge said there is no evidence of the injury- KKUK, as the prosecution claimed, has caused some damage.
We know that even those cameras and devices are not something that is necessary even for the pandemic, at that time the main problem has been to combat the pandemic, but not by recording”, Judge Foniqi said further during the proclamation of this trial.
For realising the property-juridical demand, damaged QKUK has not been instructed in civil conflict, since, according to the court, the KKUK's own management has declared that no damage has been done to the latter.
Meanwhile, the costs of criminal procedure in this case fall to the burden of this court's budgetary means.
Disgruntled parties against this act, after accepting the same written form, within the 30-day term have the right to complaint.
According to the Pristina Constitutional Prosecutor's Act, compiled on 22 March 2022, Faton Hayzeraj, Leutrim Jahja and Ylber Krasniqi, were charged with committing criminal work “due to official position or authority”, by Article 41, par.1 and 2, related to par.3, points 3.2. linked to KPRK Article 31.
According to this indictment, on December 22, 2020, in the quality of IT officials at QKUK, and in co-ordination, contrary to the Public Procure Law, in the procurement activity “Fournisation and assembly of the integrated camera monitoring system and integration of the approach control system”, the contract signed between QKUK and “Artek” have signed the Fractic report that the entire activity was carried out in December 2020, which included acceptance of goods, execution of technical work and work.
Furthermore, it is said that in this report, it has been stressed that the <x0-material accepted by the commission has been compatible with the contract, and all equipment is mounted and fully operational”, which the report according to the indictment has been contrary to the actual situation.
According to this indictment, the project has not been completed and none of the equipment has been functional, some of the goods have been brought to QKUK in September 2021, when it has become an audit of tender and publication in the media, so as a result of these illegal KKUK budget actions, they have caused material damage in the amount of 104 thousand and 751 euros.
