The initial hearing against the three indictees arrested for the terrorist attack in Zvecan Banjska, last year, has been postponed for 9 October. The delay was imposed after accused Dusan Maksimovic's lawyers, Vladimir Tolic and Blagoje Spasojevich demanded more time to read the subject's paper and prosecution evidence.
Initially at Wednesday's session, Judge Arben Hoti found there are conditions for launching initial reviews on indictees found in the detention measure. The opinion of the Supreme Court will be sought for the lack of judgment of 42 other people charged.
Similarly, special prosecutor Naim Abazi has said the rest of the terrorist group could not be captured to be brought to court. He has said that despite this, judgment can be made in absentia.
Lubomir Pantovic, lawyer of arrested Spasojevich, has rejected Abazi prosecutor's proposal for trial in the absence of 42 people.
The court has also originally ascertained that the prosecution has fulfilled the obligation to provide the case, electronically, even though prosecutors of the accused demanded that they be delivered in physical form.
Following the court's ruling that the prosecution has carried out the pledge to hand over the paperwork, Pantovic, the lawyer of one of the accused, demanded that the hearing be interrupted.
I accepted the call for today's session Monday afternoon. The same day I've been handed over as an indictment and electronic paperwork. We don't have a chance to introduce ourselves to this dynamic act. And now we've heard from the prosecution that are thousands of pages. I didn't have the chance that in an adequate way I consulted my protector and the cause of guilt today. My defenders, the indictment has yet to surrender and there is no way of knowing what Pantovic is accused of, said. This subject is complex, with serious accusations and volume documents and tests and I need time to discuss it, about the matter of admitting guilt, and I'm not able to offer protection to my defences today.
Vladimir Tolich's lawyer, Milos Delevich, also asked for more time for preparation. This indictment was prepared for a year and we have been unable to read the article and leave the subject paperwork. I ask more time. In order to prepare, we need more time”, he said.
Prosecutor Abazi has named the defence requirements unacceptable, saying the defence has made the indictment available in the reasonable term.

And Judge Hoti has said he cannot prejudge how the defendants will be declared and therefore decided that this session will continue on October 9th.
The three accused who have been held in custody since the arrest are part of the 45-person routine that had been identified by the Kosovo Prosecutor as responsible for the attempt to annex Kosovo's north in September last year. On 11 September, the Special Prosecution filed charges against former Serbian List Vice President Milan Radojic and 44 other people. They are charged with violence and heavy arms attempting to break the northern part and unite Serbia. Against them are heavy criminal acts such as “The carrying out of terrorist activity”, “Heavy works against the constitutional order and security of the Republic of Kosovo”, “Reforstation and financing in carrying out terrorism” and “Money laundering” According to the indictment, Serbia's state made weapons available to Radoicik's military infrastructure group and offered it weapons. Also, the document emphasises that Radovici was empowered by providing tenders worth about 100m euros, mostly from the Serbian state, but also from Kosovo's budget. Kosovo Sergeant Africa Bunnjak was killed by this group of terrorists on September 24th 2023 in an ambush in Banjska.
