One thousand euro fine against the lawyer over charges of misusing confidence

The Foundation Court in Ferizaj through the trial compiled on 16 July 2024 has sentenced lawyer Emine Bajrami to 1,000 euros in fines Statovci related to the charge of misusing confidence.

Under the trial provided by “Justice Vow”, on Bajrami-Statovci has initially been sentenced to prison terms of four months, which the sentence with the consent of the accused has been replaced with fine sentences in the amount of 1,000 euros.

This sentence, Bajrami- Statovci is tasked with paying him in the 30-day term after the court takes the formal form.

The trial says that if the same does not pay fines, the same will be replaced by prison sentences, where for every 20 euros of the unpaid fine will be counted by one day in prison.

The U.M. victim, with authorisation representative Vlasnim Aliu, for implementing the property-juridic demand has been directed to civilian findings.

The “based on the introduction of the date 13,06.2024, indicted after the initial review, has transferred the amount of money of 15,998.05 euros to the damaged bank account on behalf of the processing of non- material damage”, the indictment reported.

The indictment is said to have pleaded guilty to initial consideration, apologizing, and added that it was not intended to harm anyone. It says that the lawyer had admitted that the amount of money had been released in her account on behalf of compensation for the damage to the injured and that she had not been able to transfer it to the U.M. account.

Always according to the trial, the accused had vowed that after the review he would transfer the money to the injured and that he had proved that he did.

Thus, the Court confirmed beyond any doubt that there are all objective features and subjects of the work that is placed on him.

On the other hand, in the case of the court's appointment of the sentence, the Court found it extenuating to accept guilt by the accused, the regret he has shown, the fact that he is so far uncondemned with formal form bias, and that he has transferred the money to the damaged accounts.

“Based in all these courts have pronounced sentence under the pre-lawed limit based on Article 71 par.1 below 1.3 of KPRK, as well as based on Article 72 par.1 below 1.6 of KPRK, after the accused has pleaded guilty, has been carried out in the account of the damage being damaged in the name of compensation of damage...”, said in the indictment.

The serious circumstances, on the other hand, were assessed by the defendant's criminal responsibility and the consequences caused to the injury's wealth, since he had not handed over the money in 2020 when the transaction was carried out.

Bajrami-Statovci's defender, lawyer Adnan Pacolli, said they have accepted the Foundation's decision and that they have not filed complaints against him because they are satisfied with the decision.

According to the Act of Basic Prosecutorship in Ferizaj on October 1, 2020, and consistently until August 22, 2023, the defendant deliberately and in order to bring himself adverse wealth benefits, has misused her authorizations at the expense of the property interest of the injured U.M.

The indictment says that while it has been authorised by the same to care for its rich interests, to represent it in competent courts and other administration bodies, from the insurance company “Grawe Elsig” with its headquarters in Pristina on October 1, 2020, the amount of money has been transferred from 15 thousand and 998 euros to the defendant's bank account for compensation of non-matial damage to the traffic accident of August 5, 2012, in which he suffered serious bodily injuries.

The indictment reportedly in this case, the same had not reported the injured and requested his bank account, the transfer of the money from the insurance company to compensation for the injured, and did not carry the top amount to the injury account,

With that, Bajrami- Statovci was charged with committing criminal work “06/L-174.

Otherwise, lawyer Emine Statovci-Bayram was arrested on September 4th, 2023, under suspicion of misuse of faith, and was later released in regular procedure.
