EU still has official confirmation of denial of information exchange for attack in Banjska

The European Union has faced rejections between Kosovo and Serbia of providing bilateral information concerning the whitelight of the terrorist attack that took place on 24 September last year in Banjska in Zvecan. According to EU officials, although taking into account the refusal that was made through media statements, these have not been officially reported. According to them, only the Bosnia and Herzegovina Prosecutor has so far provided information to Kosovo, following the Special Prosecutor's request.
The Kosovo government has recently refused to provide information to Serbia concerning the role of Milan Radojici and his group in planning and organising last year's attack.
Until today, P The EU (the European Union's High Representative for Security and Foreign Policy) has received no official response from the Ministry of Justice in connection with the case involving Mr. Radoichi and the others. However, we have taken into account statements given to the media by Kosovo government officials for rejecting Serbia's request, with the reason that it is contrary to the Law for International Jury Co-operation in Criminal Affairs. After the EUSR officially receives the answer of Kosovo's MD, it will consider it”, EU spokesman Peter Stano said on Monday.
On the other hand, neither has Serbia offered any answers to the demands Kosovo had put on in the case, in which the former vice president of the Serbian List, the political party of Serbs in Kosovo is involved.
“Sic was mentioned earlier, in October 2023, Kosovo authorities demanded that a request for mutual judicial assistance be transmitted to Serbia's authorities to obtain evidence and documents concerning the case of Mr. Radoichi and the others. So far we have received no answer to this request from Serbian authorities”, Stano has expressed himself.
He has added that in line with the 2013 Agreement on Inter-Reform Jury Assistance, amended in 2015, the Office of the EU Representative in Kosovo facilitates the transmission of requirements for mutual judicial assistance between Kosovo and countries that do not recognise it, including Serbia.
The aim of this mechanism is to ensure judicial co-operation between Kosovo and countries that do not recognise it, including Serbia, and to facilitate access to justice for all, regardless of their citizenship or residence”Stano said.
In July, The SPBE received a letter from Serbia's Justice Ministry, which submitted a request for bilateral legal assistance to Belgrade's High Public Prosecutor in connection with the Banjska/Banjska case. Based on his mandate, The SPE in Kosovo has forwarded this request to Kosovo authorities. Under his mandate, The SPBE in Kosovo only facilitates broadcasting the requirements for mutual judicial assistance. There is no role in the judicial procedure itself. EULEX in KoSOVA has no mandate to facilitate bilateral judicial assistance between Kosovo and Serbia”, He added Stano, reports KOHA.
