The Ministry of Justice is awaiting full court judgment to proceed with amendments to the State Bureau for Verification and Confiscating of Inexistable Riches.
The Constitutional week ago brought down this law, praising some of the unconstitutional articles.
In a written response by the Ministry of Justice, they have said they are working on addressing issues raised by the Constitution.
After the Constitutional Court's announcement in relation to the Law for the Bureau, the Ministry of Justice is working on addressing cases in the bill. It's important that the Act be published as soon as possible in order to make sure that we have addressed all issues raised.”, said the MD response.
But from Movement Fol say the ministry would have to change the whole law and also change the processing group.
The “should be made with new legal designers who are professional in their work and know what a,b, laws are because we have seen that many of the cases that the Constitutional Court has disputed were actually constitutional in place, such as establishing commission competencies.”, Viona Bunjak said.
The same is expressed by the GLPS, who say that the Constitutional Court's full justice must be expected to address the findings.
“Since we have only announced so far on the Constitutional Court's decision on the Bureau Law, it should initially be expected to publish the full decision and then continue in drafting the new law by the Ministry of Justice. G The LPS requires that during drafting new provisions of the Law for the Bureau, it ensures that it rightly and fully addresses the findings of the Constitutional Office, ensures full consensus in the procedure of consulting with other actors and take positive practices by other countries that apply civilian seizures. Once this Law is intended to regulate for the first time in Kosovo the possibility of civil seizures, the series of consultation with the Venice Commission can be seen as option in the phase of drafting the new Law.”, Liridon Salihu said.
While the former Justice Ministry secretary hopes the Constitution's full decision will not take too long, as it will cause delays in law proceedings.
The Constitutional Court does not have deadlines, but as far as this initiative the Court has exceeded any limit so far, because there is a long deadline that has been taken with treatment and I believe the drafting will not take much time, because I believe the same with the review case, approval has only been a draft considered.”, Ardian Bajraktari said.
By telephone from the Constitutional Court, television has confirmed that they are on the map of full justice but cannot talk about when it can be available.
This bill was passed in February 2023, but The PDK sent him for assessment at the Constitutional Court.
