The Appeals Court has overturned the 18-year-old L.F. murder case for retrial. Podujevo. This ruling annuls the constitution of the Constitutional Court in Pristina, with which the first minor was sentenced to 10 years in prison and the second minor to 9 years in prison.
The Appeals Act was taken on July 17th, 2024, with which it has been approved as being based on the complaint of the protector of the first minor, lawyer Skender Musa and second minor defender, lawyer Florent Latifaj.
According to the University of Court of Appeals' assessment, the lawyer Musa's claim that the court's chairman, Lumnije Krasniqi, has been judge of the preliminary procedure in the same criminal case.
Appeal estimates that Judge Krasniqi has had to be excluded from the trial of this criminal case.
Apel's decision notes that the judge for minors in the preliminary stages has participated in this criminal case in the preparation procedure, assigning and continuing the measure of detention to two minors. It says that the same in the case of the establishment of this criminal case has participated and has decided on the quality of the court's chairman.
Always under that decision, although in the Code of Justice for Injury this issue is not specifically regulated, the provisions of the Criminal Code and the Code of Criminal Procedure apply.
According to Appeal, based on the Supreme Court's legal opinion, it is said that it cannot be the only judge, a member of the court, a court judge in the first court, who has appointed/extended the detention measure. /“Justice Trust”
