Consumption on subsidies, six charged plead guilty

At the initial session to 12 officials and six farmers who are accused of fraud by subsidies and other criminal acts, 11 of them have been declared innocent, 6 of them have reached plea agreement, while for one the procedure was singled out.

According to the indictment provided by the “Justice Vow”, in this case the 12 officials are charged: Hasan Maharaj, Luan Statovci, Sadat Shkodra, Purvis Zogaj, Jeton Sylaj, Granit Lubeniqi, Adrian Ramqaj, Lulzim Hajdaj, Musa Neveoazi, Bajram Gashi, Ramiz Ramosaj, Dritton Alaj, and 6 farmers: Alif Idrizaj, Dien Zogaj, Shemseddin Metaj, Burim Shabanaj, Deli Metaj and Besmir Bicaj.

After reading the indictment by prosecutor Valbona Dishaji-Hajoaj, accused Hasan Maharaj, Luan Statovci, Zogaj, Granit Lubeniqi, Ardian Ramqaj, Musa Neveoazi, Bajram Gashi, Ramiz Ramosaj, lives Sylaj, Lulzim Hajdaraj and Sedat Shkodra, have been declared innocent in the face of charges imposed on you.
While the accused, Arif Idrizaj, Dien Zogaj, Shemseddin Metaj, Burim Shabanaj, Deli Metaj, Besmir Bicaj, had made deals for pleas along with the prosecution.

The accused Zogaj, Idrizaj, Metaj, Shabanaj and Metaj, had also been declared co-operative witnesses in the case.

And where, according to the judge, the chairman of the Nushe Kuka-Mekaj court accepted the plea agreement, where, according to the judge, the same are related to the legal provisions of Article 230 par.17 of the KKP, so that in accordance with KPPR's Article 230 par.20, arrangements were accepted for pleas.

Judge Kuka-Mechaj said the sentence would not be pronounced on them until they fulfil their pledge as collaborators in the case.

As for accused Besmir Bicaj, as the same was no co-operative witness to him the conviction declaration would take place on June 3rd, 2024.

The other defendants have been instructed that in the 30-day term, they have the right to reject evidence and cast the charge.

Otherwise, in this session, the accused Driton Alaj was absent, where, according to the fact that he had earlier sought to isolate the procedure against him, because the works do not connect together with the other indictees, and that following the reconciliation of all parties in the procedure, the procedure has been isolated.

They are charged with committing criminal acts “due to the use of official position or authority”, “Taking bribes”, “Brigane code”, “sub-submission”, “Task Dece> and <x10Help in carrying out the criminal act misuse of official duty or authority”.

According to the indictment, accused Hasan Majarraj from August 28th 2020, and in progress until December 18, 2020, in Istog, as senior agricultural policy official in the Istog municipality, accepts bribes from other accused Shemsdin Metaj and Burim Shabanaj the amount of 3 thousand and 600 euros to try to approve their subsidies.

With these actions, Maharray is accused of committing criminal work “taking bribes”, from Article 421, par.2, regarding Article 77 of the Penal Code.

The Actakuz says that Hasan Majaray, in 2019 and 2020, in Istog as an official person in order to benefit rich for the other person who exceeds 5 thousand euros and for Haziri Metaj, Haxhi Metaj, Nimon Berisha and Imeraj, contrary to the Agriculture Ministry's Adminstrative Guide, Forestry and Rural Development (MBPZHR), accepts apps for these farmers and introduces them into the land parcel identification system.

The indictment said that farmers had applied to the land of the Istog municipality, for which they had no permission, but that Mahjar allowed the profit of 5 thousand and 310 euros, causing damage to the budget of the Republic of Kosovo.

With this, Maharray is tasked for “Using official position or authority”, by Article 1414, par.2. About par.1 and KPRK Article 77.

The indictment reportedly states that accused Hasan Magaraj and Luan Statovci, in December 2020, in Istog and Pristina, as co-chairman in the quality of official persons, Mahzaraj directly accepts bribes from accused Deli Metaj, and Luan Statovci as director of direct payment to the Agency for Development of Agriculture, indirectly accepts bribes from Deli Metaj.

According to the indictment, the accused Majaraj to approve the Metaj subvention without meeting the conditions that benefit himself at a total of 2 thousand and 529 euros, while on behalf of his wife Igballe Nikqi, Metaj benefits from 8 thousand and 574 euros after the accused Del brings the money out of the bank account gives it to his late parent and he bribes it to the accused Magjarej at a total of 4 thousand euros, the latter gives it 2 thousand euros.

For this, Maharray and Statovci are charged with criminal work “Taking bribes”, from Article 421, par.2 concerning KPRK's Article 31.

Insist, according to the indictment, accused Luan Statovci and Sadat Shkodra, both as official and responsible persons for direct payments at AZHB are charged with “taking bribes” from Article 421, par.2 regarding Article 77 and Article 33 of the Penal Code.

The Actakuz says Luan Statovci accepts bribes from the Zogaj Counterfeit, to act contrary to his duties, where the accused Sadat, contacts accused Dine Zogaj, regarding some irregularities in his application for subsidies, for which the same one requires 1/3 of this subsidy for approved, accused Sadat Shkodra has accepted a direct bribe of 2 thousand and 500 euros, while accused Luan Statovci in an indirect manner of 2 thousand euros.

Indictee Zogaj is charged from July 12th, 2019, and continuing until August 28, 2020, exploiting his office as a senior agricultural policy official in the Istog municipality, applies for subsidies to himself with documents of his uncle Dien Zogaj for his uncle Fadil Ferrataj's property, without his knowledge of it, and after the money comes to the bank in many of the 36m and 50 euro in the name of the Birdy, it gives him all the money charged by Coven.

The Zogaj surrender is also charged that after the application for subsidies, others benefit from 2 thousand and 850 euros, 1 thousand and 752 euros, 4 thousand and 99 euros and 50 euro and 5 thousand and 830 euros, and, at most, 22 thousand and 517 euros, causing damage to the Republic of Kosovo budget.

Also, the indictment states that Zogaj by his actions by allowing the application for subsidies jointly by exploiting the land of the Istogu Community for Uka Idrizaj farmers, Edsim Delijaj, Nazmi Kamberaj, Kamber Balaj, Ahmet Metaj, Ahmet Metadaj, Shyhrete Hajdaraj, Shemsi Delijaj, Tim Demiraj, Edonis Hajdaj, Demaj, Demaj, Sadaj, Qadbashi, Genvdet Metaj, Agron Krasniqi, Hiedabetaj, Ahmaj, Tahiraj, and Albania allow them 25 thousand euros of this value in Kosovo's budget.

For this, Zogaj is tasked with criminal work “Using official position or authority”, by Article 414, par.2 related to par.1 and KPRK Article 77.

For the benefits through these actions, the accused Zogaj tasked with the “bribe chamber” by Article 422, par.2 concerning KPRK Article 77, after being charged with giving the accused Sadat Shkodra the amount of 1,000 and 500 euros and 3 thousand and 500 euros.

Always in accordance with the indictment, the Zogaj Counterfeit, for presenting inaccurate data to the Competit Organ is charged with criminal activity “Substitute”, as it has caused damage to the Republic of Kosovo budget and that amount of 22 thousand and 517 euros.

According to the indictment, the accused Jeton Sylaj, official at the Istog Community Directorate of Agriculture, in 2019 and 2020, in Istog, accepts the apps for Istog farmers who had applied for land subsidies to the Istog Community, allows and introduces them into the proper software and the farmers Elez Haradinaj, Rexaj Metaj, Muhamet Metaj, Milazim Metaj, Bekim Haskaj, Laboni Kabashi, Rutelle, Enver, Karadaj, Losaj Hajdaj, Shidaj, Shidaj Ferjaj, Zhalusaj, Hajaj, Bajram Sakarey Sakaylajlaj, Shidaj Ferdaj Ferdaj Jahdaj Jahaj.

With that, he is charged with enabling them to benefit the amount of 19 thousand and 284 euros and in this value causes damage to the budget of the Republic of Kosovo.

The point is to blame for the criminal act “The use of official position or authority”, by Article 414, par.2 related to par.1 and KPRK Article 77.

According to the indictment, accused Granit Lubeniqi, official at the Istog Community Directorate of Agriculture, in 2019 and 2020, in Istog, accepts the apps for Istog farmers who had applied for land subsidies to the Istog Community, allows and introduces them into the respective software and farmers Lus Qukaj, Bajramaj, Azlla Veselaj, Enver Idrizaj, Agim Ahmetaj, Raj Idrizaj, Jane Hajdara Hajdaj, Velmir Moqmov and Renq Mopov. With that, it has enabled them to benefit the amount of 6 thousand and 862 euros, and in this value it causes damage to the budget of the Republic of Kosovo.

Lubeniqi, with this charges the criminal act “The use of official position or authority”, by Article 414, par.2 over par.1 and Article 77 of KPRK.

According to the indictment, accused Adrian Ramqaj, official at the Istog Community Directorate for Agriculture, in 2019 and 2020, in Istog, accepts the apps for Istog farmers who had applied for land subsidies to the Istog municipality, allows and introduces them to the respective software and to Sabit Sadrijaj, Muje Metaj, Sefedin Saliaj, Star Halilaj and Hize Jahaj.

With that, he is charged with enabling them to benefit the amount of 2,000 and 400 euros, and in this value it causes damage to the budget of the Republic of Kosovo.

With this, Ramqaj is charged with criminal work “Using official position or authority”, by Article 414, par.1 and Article 77 of KPRK.

The attack, according to the indictment of accused Musa Neveokoazi and Lulzim Hajdaraj, from October 30th 2020 and continuing until November 27, 2020, on Istog and Decan, as AZHB inspectors, as co-chairman, with the aim of illegally benefiting property benefit for other people, puts into play the person authorised to pay subsidies, which benefits more than 5 thousand euros, in case of conducting controls in post-aggressive data.

With those actions, the same acts are said to have enabled farmers to keep up with the amount of 34 thousand and 753 euros, with these acts charged with criminal activity “duty fraud”, from Article 419, par.3 related to par.1 and Article 31 of KPRC.

For the same criminal act, the two above-mentioned are also charged with partitioning (Hajdaraj in the 13th device of the indictment, while Neveocazi on the 14th device).

Defenders Musa Neveopolis and Bajram Gashi, in quality of official persons, are charged with how co-chairees committed criminal work “duty fraud” by Article 419, par.3 related to par.1 and Article 31 of the Penal Code. For the same criminal act, Ramiz Ramos is also charged in the quality of the official person.

Indictees Arif Idrizaj and Dine Zogaj are charged with their actions allowing accused Zogaj to benefit the 15 thousand-951 euros and 6 thousand 736 euros.

Idrizaj and Zogaj are charged with “assist in carrying out the criminal act misuse of official detail or official authority” by Article 33 concerning Article414, par.2, par.1 and Article 77 of the Penal Code.

While accused Shemsedin Mataj is accused of benefiting official Hasan Majarray of 3 thousand and 600 euros, as well as presenting inaccurate data on the takeover. The defendant Burim Shabanaj, on the other hand, reportedly a subvention of 13 thousand and 107 euros, 3,000 and 500 received them, and 4 thousand handed them over to the defendant, and the defendant Metaj takes the rest. The same is accused of presenting inaccurate data on the takeover. Deli Metaj, on the other hand, is accused that through his parent, he had given the accused Magyarj the amount of 4 thousand euros, and is charged with presenting inaccurate data to the competent body to obtain subsidy.

With that, Mataj, Shabanaj and Metaj are charged with committing criminal acts “Bribery divorce”, by Article 422, par.2 KPRK's and sub subsidies “Deception”, from Article 324, par.1 related to KPRK's Article 77.

According to the indictment, Driton Alay (program at AZHB) is charged with presenting incorrect data near the competent body in the case of obtaining a subsidy, exactly portraying a parcel of different agricultural cultures, with approval of the subsidy. With that, it reportedly caused damage to the state budget of 17 thousand and 980 euros.

With this, Alaj is charged with committing criminal work “The sub-submission” by Article 324, par1. Penal Code.

Besmir Bicaj, on the other hand, is accused of also presenting incorrect data on receiving a subvention, declaring that it was planted in organic culture more than it had, but that even though it had been approved to subsidies, it had not received payment.

With that, Bicaj is charged with committing criminal work “Substitute fraud” by Article 324, par1. Penal Code.
