Justice Minister Albulen Haxhiu has accused the Constitutional Court of deliberately delaying and obstructing reform in justice. Haxhiu said the government, with concerns raised over delays in dealing with laws on the part of the Court, is not making interference in justice but, according to her, the court's intention to prevent reforms is unacceptable.
The ruling statements against the Constitutional Court have no stop. After Prime Minister Kurti and Justice Minister Albulen Haxhiu accused the Court of obstructing reform in justice.
Minister Haxhiu said the constitution is deliberately delaying the treatment of the laws and that government statements are only concerns expressed about these delays, not interference in the work of the Court.
The government didn't interfere with the court's work. It's important that this be repeated, and I disagree with anyone who says that the expression of concern in relation to delaying the treatment of our laws is intervention, I cannot agree because it's not intrusive. I think that (the legal treatment delay) is intentional because there is no other reason to justify the delay that the Constitutional Court is making for reasons why it is intentional, but it is clear that delays are intentional, but I think that the Constitutional Court should be concerned about the importance of these laws and that the Court knows the serious situation in which is the justice system, and the reforms that we have addressed are very important and our goal is that the institutions of justice are independent, so its Constitutional Court has a lot of cases that have returned to court in a sense that is also a professional knowledge of, but that seems to be an open and open reform, and that is unacceptable.
On the other hand, the Constitutional Court continues to remain silent in the face of charges of power.
Regarding government charges against Constitutional Court for obstructing justice reform RTV21 addressed the Constitutional Court, but the same so far has not returned any answers.
Former Justice Minister, PDK parliamentary Group chief Abelard Tahiri, estimates that on charges against the Constitutional Court, the government is trying to find a blame for its failures.
It's an excuse for their ongoing failures that they've had now when they're closing the mandate. When we see their deeds even the justice sector is left to wish.. The Constitutional Court has been repeatedly attacked. They're always looking for a guardian guilty to blame for their failures. First beyond the knowledge they have shown, they have had bad intentions to harm and weigh down on this constitutional order that we have so far had”, Tahiri said.
LDK MP Driton Selmanaj, meanwhile, says the current Government's statements to the Constitutional Court are absurd and that she is not interested in reform in justice at all.
Paralytic “I think is an attack on the Kosovo Constitutional Guardian, there is no point in those statements. The Constitutional Court for Our Good Fate has defended Constitution, defended the constitutional democracy we have, we as a political party have exploited all instruments of parliamentary control... They are not interested in justice reform at all”.
The opposition countered Minister Haxhiu.
“Reforms in justice have been delayed by the opposition and the Constitutional Court since the first day, we have been working on the greatest commitments we have given citizens in self-preservation and justice, we have the approval of the opinion of the Venice Commission and the Constitutional Court, constitutional amendments are in the Parliament, the Reform for the Prosecutorial Council is still in the Constitutional Court... The Bureau for Confiscating Property is expected to be voted into session these are three of our main projects addressing justice reform everything that is dependent on us... It has been clear that the opposition does not want reforms in Justice, that it wants fighting corruption and organised crime, does not want reform at the Prosecutorial Council”, Haxhi said.
During the week, the EU Office in Kosovo said the Constitutional Court should be independent and free from political pressure and that judicial independence is a cornerstone of rule of law and essential criteria for any democratic society.
