Shkullaku: ARBK's decision on Klan Kosovo today received comedy treatment

According to the media report, the decision yesterday that annulled the preliminary decision to suspend the Bank's business certificate, reportedly has been cancelled.

Opinionist Armand Shkullaku said today's decision to ARBK's got comedy tricks.

The first time the decision was very disturbing, it was undoubtedly violent interference with the media, regardless of what media are talking about, removing my personal side with Klan Kosovo, but I have the same opinion of any media. And today it seemed to me as if he had taken the forms of comedy! Because suspension of the suspension decision? So there's come a rebus that I think is comedy, for two reasons: first, because it doesn't happen that a decision for a national media, for an important media, more importantly I would say in Kosovo, to make a decision so easily, which turns out to be taken wrong, then it's corrected, then it becomes correctional... So this is the part that shows how a thoughtless action and this do-sydo has the elements of comedy, and I call it comedy even for the next fact that this is a battle I would say lost from the beginning, in any power, whoever it is, the battle with the media is lost from the beginning of”, Shkullaku said.

He then said that if it were for an annomic media, which does not know the address and content, then “of course that the state structures and bodies responsible should deal with it”.

But, he said that in the concrete case, a licensing media is being talked about and its right to broadcast is not certified by both the ARBK and the government, nor the institutions, is certified by Kosovo citizens.

“In 14 years we have a media like Klan Kosova, which has an opportunity accepted by the citizens of Kosovo, has a framework from the highest quality, and which is never having problems in these 14 years that may have touched interests, which may have violated someone, which may have called for warmongering, racist calls, provocative programs, which are predicted in the licens of any media, so if its programme violates certain such rules, then surely the right of transmission should be reconsidered. Here we talk about a media that has an employee of about 200 people, they live in Kosovo, they work in Kosovo, they produce in Kosovo, and their production is a public product that is certified by the public”, he further stressed.

On the other hand, he also spoke about the issue of Kosovo's subjectivity, saying that the content of the Kosovo clan, Klan Kosova itself, is a separate judicial subject.

According to him, media owners or shareholders may have problems, but they, according to Shkullaku, do not represent the subject.

“The legal subject has several rules for which it is certified. I may commit a violation as an owner, but this does not penalise another legal subject that is certified because of the programme. I think the sooner this story closes, the better for the government. I don't know if it's done by order, I can't put my hand on fire if there's a directive to hit the Kosovo Clan... I'm saying that an hour ago, the government must understand that the length of this story will turn into boomerang, both for the prime minister and the government. And from their pragmatic point of view, politics has no kind of benefit, no sense of continuing such a matter. It's totally absurd to me. If they have problems to verify from the point of view of taxes, taxes, verifications are state right, and we all have no immunity against law”, Shkullaku said.
