Albert Kinoll disappointed with the Constitutional decision: Indeed, they were clear signs and manifest signs

Kinoll expressed disappointment with the decision, but said the same is inconsistent.

I have made the official decision. We know that the Constitutional decision is inconsistent. I'm not happy with this decision, but we're more confident in the Constitutional. We've got hard facts and arguments, but my request has been denied”, Kinoli said of T7.

The Constitutional Court has made the decision today in terms of former deputees Albert Kinoll and Veton Berisha's demands for assessing the Constitution of the Supreme Court's Act.

The Constitution in its decision to appeal to MP Veton Berisha has found that “Vota in the Republic of Kosovo is personal, equal, free and secret. The vote cannot be annulled/invalid based on ethnic belonging to voters”.

As far as MP Albert Kinoll is concerned, the Constitution has praised his complaint as unacceptable as a result of failing to rule legal means prescribed by law.

Supreme Court has not violated the right of the petitioner, respectively. PLE, to be elected to the Parliament after the February 14th, 2021 parliamentary elections, according to Article 1 of Article 45 [The Election Rights and Turnout] of the Constitution regarding Article 3 (Right for Free Election) protocol No. 1 of the European Convention on Human Rights; and (iv) to establish that this Act has no reform effect and that, based on the principle of judicial security, does not affect the rights of third parties”, it is said, among other things, in announcing the decision by the Constitutional Court.

The United Roma Party of Kosovo, represented by Albert Kinoll and the Egyptian Liberal Party, represented by Veton Berisha, had claimed that the parties of these communities had won in the February 14th elections of 2021, receiving <x0 votes orchestrated and co-ordinated with the Serbian List”, and as a consequence other political subjects have exceeded their number of votes and have taken their place in the Assembly.

The Constitutional also in its act states that “the financing of designated seats in the Assembly for communities that are not majority, based on constitutional and legal provisions as clarified earlier, not necessarily include the obligation that these countries could be won only if they were voted by the same community that is not majority, while conditioning for active electoral rights in ethnic affiliation<1>.
