The Assembly has also adopted a draft law establishing a war crimes institute sponsored by the Ministry of Justice, but this issue is not very current at the time Kosovo-Serbia negotiations are under way.
The newspaper Express talked about this with Enver Hasani, professor of International Law. Hasan has called Kurti's “positive and unserious” pledge to sue Serbia.
How do you now see Prime Minister Kurti's recent promise that he will file charges of genocide against Serbia?
Hasani: That promise has been fictional and inconsistent.
How hard is this lawsuit to be accepted by the JND?
Hasani: Just because this is completely impossible, I said the promise was fictional and incompatible. It's for the inner gallery of average voters.
Can Kosovo file a lawsuit that is legitimately argumentable?
Hasani: The merits of a genocide case against Serbia, perhaps even could be built. I say it's probably because it's been a long time and the evidence that has been legalised has been compromised for most of the irresponsible people by producing them to books written for propagandistic purposes and for personal commercial benefits.
In the event of reaching agreement on March 18, what do you think the epilogue of the indictment will be?
Hasani: No ties have between the March 18th agreement and the indictment against Serbia for genocide, which, as I said, is the eternal and non-serious promise. If such an indictment were eventually filed, then it would be the greatest gift to be given to Serbia and the regime in Belgrade.
