Danny Alves' case, what can he do to get out of jail?

Alves has been accused of raping a girl at a Barcelona nightclub on December 30th, Periscope follows.
The question is what Alves can do now. If he wants to get out of prison until trial, his lawyer will have to file another appeal, which can be based on two ways.
Alves lawyer:
Cristobal Martwell, the Brazilian lawyer, made a statement in which he already disagreed with the Court's ruling:
The “is an asymmetric decision because it uses as evidence statements made by police and, on the other hand, the elements offered by the defence are pressed for verbal judgment”. The new appeal may aim to reject this line.
Presenting further complaints:
He may also insist on the fact that the former player has no intention of escaping from Spain, something he already did in his earlier appeal, his “will-be-volunteer to leave Spain and avoid the process is and was in existence”.
What's clear is that the lawyer can file any complaint he wants. In Rose's case it's been done up to ten times.
What remains to be seen is how advanced the investigation is in this case. If it were to go as fast as it seems to be going, it would not take long for the trial to develop and then there would already be a sentence for alleged crime and there would be no need for preliminary release.
