Commission approves in principle amendment to KPM board dismissal law

This amendment to the commission member's proposal, from the ranks of LVV, Mimoza Kusari Lila, has occurred to avoid administrative disputes in the administrative court following the dismissal of the Independent Commission for Mine and Mines Board.
Kusari proposes that the only institution for complaint remains the Constitutional Court.
“We have been proceeding with the completion of the Law for Mines and Mines change because in relation to all other regulatory agencies that report to the Assembly there are two provisions in this bill in which the Board's dismissal procedure envisions the administrative dispute in the administrative court, namely that all other institutions are clearly regulated at the moment and are dismissed from the only higher body's location where appointed persons' complaints can be prosecuted and that is the Constitutional Court. In this case, we have analysed and seen as such this provision is at odds with the very concept of the state of the Parliamentary Republic in which the Parliament is the highest legislative body and decisions of the Parliament except that the Constitutional Court in other procedures that are regular for the appointment and dismissal of the boards in this case is incompatible to”.
Therefore, we have taken the decision to fulfill the change under the constitution's regulation with the signatures of the deputies we have prosecuted further to the government for opinion, the government on February 16 of this year has turned their opinion into which this bill is meant to be in accordance with other provisions, and there is no stop for this to be prosecuted further”, she said.
The chairman of this commission, Ferat Shala, said that completing the change of Law for Mining and Minerals should not go with rapid procedures. / KP
