The ombudsman, Naim Celaj, has announced that the Law for Elections will be delivered to the Constitutional Court, Online Economy reports. At the recent conference for this year, he added that he has sent letter to President Vjosa Osmani, even said it is not in his own competence, which law is binding on political officials or not.
This is after his statement in a debate in the country became “concerned the fight”, between President Osmani and Prime Minister Albin Kurti. The key confirmed that the Law on Elections has surpassed it for gender equality, and that the Constitution does not allow it.
“Logically, even in practical terms, the ombudsman considers it necessary. You know the election law has passed with a session without any public discussion that would take all discussions concerning topics that might be controversial. The law has passed without including one of the important aspects that the Constitution of Kosovo defines and the law on gender equality. I refer mainly to what the Constitution says, in Article 7 of the Constitution to definition of values it has been explicitly stressed that constitutional value in our country's judicial system is gender equality, and in case we have a quota of 30 and we don't have equal equality 50-50 for me is contrary to this constitutional principle of”.
“This quota should not be misunderstood does not concern the number of deputies and deputies in the Assembly, so it is not the minimum quota of representation of women in the country, it is only the minimum quota of women's involvement in the candidate lists for the Kosovo Assembly and for local election lists. The next day we have addressed the Kosovo presidency with a letter, we have made the letter public, where the reasons and assessment the Ombudsman has made the case. I haven't managed to hear what they've been talking about, and for the ombudsman it's a little important that people discuss, the important thing is what I create as a belief, and when I find that a matter needs to be submitted to the assessment of the Constitution, I believe that this should happen”, he said.
When he spoke of dealing with former KLA members in The Hague, he said there is no proper communication with the Special Court's Ombudsman. According to him, limiting visits may be viewed as violating the rights held by prisoners there.
I haven't had enough communication with the attorney of the Special Chambers. Early in 2021, I had communication. I've asked to meet you on the visit I've been to The Hague, but I've been told it's in The Hague and I don't have a communication with this ombudsman until today. In terms of whether or not it represents and violates human rights measures for limiting visits, I also believe on the basis of the competencies and responsibilities that I have that the minimum rights that a prisoner should have are just as important as necessary to be respected. The privacy of visits to me poses a problem and concern. Even the very limit of visits to the period when an indictment was established, evidence was provided, witnesses were provided, I consider them unnecessary and may be considered to be a violation of the rights held by prisoners there”, he said.
The key, said this year they have accepted 571 complaints. He said that for authorities that are mostly addressed complaints are courts, ministers, municipalities. The cell said worrying about the ombudsman has also been receiving and reporting with P results ISA. He said institutions have not fulfilled their obligations for justice for war crimes.
This year has been challenging for many causes, faced with various situations. The number of complaints and cases that the ombudsman has handled this year, we have accepted 1571 complaints this year, open cases are 608. The polls according to communities this year have been growing -- Serbian 148, Bosnian 22. Even this year, the citizens' faith has led to many complaints. The authorities responsible for which most have filed complaints are courts, municipalities. The recommended reports this year are 230 recommendations. This year we have a reduction in the implementation of recommendations”.
This year we've addressed five cases, we've addressed you to the Constitutional Court with five cases. We have submitted the law of wages, the law is pending assessment. We have also been addressed with comments to the Constitutional Court about the fulfillment and amending of the law that determines minimum wage excesses. We have also addressed comments about the Code of Criminal Procedure. Comments we've also sent about the draft law on the Bureau of Prefiscating Property. And the last is the law for public officials”.
We've investigated 47 textbooks. The report is derived from the research of 47 1-9 grade textbooks, in order to investigate whether they are in line with international standards and global policies for awareness of hate language and such that promote diversity and equality, while avoiding the content of hate speech and discrimination. The report has shown that there is some progress, analysis has shown little finding, so it is encouraging to improve and institutional attention that textbooks are in line with acceptable standards. The state has not met its obligations to the victims when it comes to collecting the war crimes document. By this year we have not had a clear strategy”, he said.
