The Office for Partition of Victims (ZPV) has submitted the sixth report on the victims' applications to be participants in the procedure against Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, where, out of 50 sosh, 30 have met the conditions, already 20 of the applicants have failed to meet them. In this sixth report, ZPV reportedly broadcasts 50 requests for the status of the participating victim in the procedure to the judge, and provides a recommendation for compliance, grouping, joint representation and safeguard clauses, reports the “Best for Justice”.

As for Group A, reportedly victim-97/06 applicants, victim-99/06, victim-100/06, victim-1 0106, victim102/06 and victim-1/03/06 are members of the same family. According to the report, they claim to be indirect victims of the forced disappearance and illegal detention of a close family member.

On the other hand, close family member is said to have been sent to one of the detention sites mentioned in the amended indictment in the respective period, and that researchers claim they have suffered mental damage and some even material.

They are also said to have handed over all support documents available for the damage.

“Aplicants victim-1/1006, victim-112/06, and victim-163/06 are members of the same family. They claim to be indirect victims of persecution, illegal detention, forced disappearance of cruel treatment and the murder of a family member. The family member was sent to one of the detention sites mentioned in the amended indictment in the respective period. Researchers claim to have suffered mental and material damage. They've delivered all support documentation they owned”, said further in this report.

According to the report, victim applicants-121/06, victim-122/06, victim-23/06, victim-124/06, and victim-12/05/6 are members of the same family. They reportedly claim to be indirect victims of the disappearance and violent murder of a family member.

The family member is also said to have been sent to one of the detention sites mentioned in the amended indictment in the respective period, and that researchers claim they have suffered mental damage.

According to this report, they indicated that they had no documentation for the damage.

The forger victim-180/06 reportedly claims to be an indirect victim of the kidnapping and murder of two close family members. According to the report, their remains were found at one of the crime sites mentioned in the amended indictment in the respective period, and the researcher claims he has suffered mental and material damage and does not have any supporting documents.

Victims applicants-186/06, victims-187/06, and the victim 1288/06 are said to be members of the same family.

The report says they claim they are indirectly victims of the kidnapping and murder of two close family members and that their remains were found at one of the crime sites mentioned in the amended indictment in the respective period.

The report says researchers claim they have suffered mental and material damage and that they showed they had no documentation of the damage.

“Aplicants victims-191/06 and victims-212/06 are members of the same family. They claim to be the indirect victims of the forced disappearance of a close family member. The family member was sent to one of the detention sites mentioned in the amended indictment in the respective period, and the family was denied the information. Researchers claim they have suffered physical, mental, and material damage and have no support documents”, the report says.

Predator victim-19/05/6 reportedly claims to be the indirect victim of the forced disappearance and murder of a close family member and that the family member has been sent to one of the detention sites mentioned in the indictment amended in the respective period. On the other hand, the researcher reportedly claims he has suffered mental and material damage and has no support documentation.

“Aplicants victims-196/06, victims-197/06, victims-198/06, victims-199/06, victims-,200/06, victims-21/06, and victims-202/06 are members of the same family. They claim to be indirect victims of the kidnapping and murder of two close family members. Their remains were found at one of the crime sites mentioned in the amended indictment in the respective period. Researchers claim to have suffered mental damage and some of them also. They indicated that they had no documentation for the damage”, the report says.

According to the report, the forger victim 2/03/06 claims to be the indirect victim of the forced disappearance and murder of a close family member and that the family member has been sent to one of the detention sites mentioned in the indictment amended in the respective period.

The report says that the family tried to obtain information about the direct victim but failed and that the researcher claims he has suffered mental and material damage and has no support documentation.

Forger Victims-200406 reportedly claims to be the direct victim of illegal detention, cruel treatment and torture by the KLA at one of the detention sites mentioned in the indictment amended during the actual period.

The report says that the researcher claims he has suffered physical, mental and material damage and has no support documentation.

As far as Group B is concerned, it is said that the forger victim-88/06 and claims to be an indirect victim of the kidnapping and murder of two close family members on Kosovo's territory within the period of the indictment.

The report says that the events described cannot be linked to charges as specified in the amended indictment.

The researcher also reportedly claims to have suffered mental and material damage and that the applicant submitted a medical report as supporting documentation and indicated there was no other document.

The report says the pre-torator victim-90/06 claims he is an indirect victim of torture and murder by the KLA of a close family member in front of their home on Kosovo territory within the period of the indictment.

“The situations described cannot be linked to charges as specified in the amended indictment. The researcher claims to have suffered mental and material damage. The applicant handed over all support documentation available”, the report says.

According to the report, victim applicants victims-89/06, victims-91/06, victims-92/06, victims-93/06, and victims of94/06 are members of the same family.

“They claim they are the indirect victims of the murder and cruel treatment of two close family members in their family home on Kosovo territory within the period of the indictment. The events described cannot be linked to charges as specified in the amended indictment. Researchers claim to have suffered physical, mental, and material injuries. They indicated that they had no documentation for the damage”, said in this report.

The report reportedly reports that victim applicants victims 10-0406 and victims-1/05/06 are members of the same family.

“They claim they are the indirect victims of the kidnapping and murder of a close family member from the KLA on Kosovo territory within the period of the indictment. The events described cannot be linked to charges as specified in the amended indictment. Researchers claim to have suffered mental and material damage. They handed over all supporting documentation available”, said further in this report.

Next, it is said that the forger victim-10/07/06 claims to be the indirect victim of the forced disappearance of a close family member on Kosovo's territory within the period of the indictment.

The report says the events described cannot be linked to charges as specified in the amended indictment.

The researcher claims to have suffered mental and material damage. The applicant handed in a medical report as support documentation and showed that there was no other document”, said further.

Also, reportedly victim applicants-1/09/06, the victim-161/06 and the victim-162/06 are members of the same family.

“They claim they are the indirect victims of the kidnapping of a close family member from the KLA on Kosovo territory within the period of the indictment. The events described cannot be linked to charges as specified in the amended indictment. Researchers claim to have suffered mental and material damage. They handed over all support documentation available”, the report says.

Also, reportedly victim applicants-1/09/06, the victim-161/06 and the victim-162/06 are members of the same family.

“They claim they are the indirect victims of the kidnapping of a close family member from the KLA on Kosovo territory within the period of the indictment. The events described cannot be linked to charges as specified in the amended indictment. Researchers claim to have suffered mental and material damage. They handed over all support documentation available”, the ZPV says.

According to the report, the forger victim-16/05/6 claims to be the indirect victim of the forced disappearance of a close family member on Kosovo's territory within the period of the indictment.

“Aplicants victim-167/06 and victims-171/06 are members of the same family. They claim to be indirect victims of the kidnapping and murder of a close family member from the KLA on Kosovo territory within the period of the indictment. The events described cannot be linked to charges as specified in the amended indictment. Researchers claim to have suffered mental and material damage. They indicated that they had no documentation for damage”, the following says.

The report says the victims' applicants, 168/06, the victim-169/06 and the victim-170/06, are members of the same family.

“They claim they are the indirect victims of the kidnapping and murder of a close family member from strangers on Kosovo's territory within the period of the indictment. The events described cannot be linked to charges as specified in the amended indictment. Researchers claim to have suffered mental and material damage. They indicated that they had no documentation for damage”, the report says.

The ZPV reportedly recommends to the judge of the preliminary procedure to accept 30 applicants as participating victims: Victim-97/06, Victim-99/06, Victim-100/06, Vicim-1 01/06/, Vicim-102/06, Victim-103. /06, victim-110/06, victim-112/06, victim-163/06, victim121/06, victim-122/06, victim-123/06, victim-124/06, victim-12/06/06, victim -180/06, victim-186/06, victim-18/06, victim-188/06, victim-191/06, victim-212/06, victim 1906, victim-1906, victim-198/06, victim-198/06, victim-199/06, victim-06, victim-20/06, victim 01/06 victim, victim, victim,-2/06, victim, victim-2-25/06, 42/06 terrorist victims, and 42/06 victims.

The ZPV has estimated that 20 applicants victim-88/06, victim-90/06, victim-89/06, victim-91/06, victim-92/06, victim-93/06, victim-94/06, victim -104/06, victim-106/06, victim-10/07/06, victim-1/09/06, victim-161/06, victim-162/06, victim-16/06, victim-1606 victim, victim-16/07/06, victim-17/06, victim-17/06, victim-1/06 victims, victim-126/69 victims, and victims of the deceased/69/06 do not have enough ground to prove their existence. Prima facie that the events described in their demands, from which they claim to have suffered injuries, fall within the material, time and geographic realm of the charges, as described in the amended indictment.

Consequently, the ZPV has recommended to the judge of the preliminary procedure that he reject these applicants for participating as victims in the procedure.

In the framework ruling, it is said that the judge of the preliminary procedure listed relevant safeguard clauses in this phase of the procedure.

“The safeguard measures required by applicants can be summed up as follows: 13 applicants demanded non-discovery for the public; a total of 12 applicants demanded non-discovery for the public and the accused; three applicants demanded anonymity of the accused; six applicants demanded non-discovery for the public, accused and defence lawyer; Four applicants demanded non-discovery for the public, Prosecution, the accused and the defender; and twelve applicants asked for nothing”, the report says.

For Group A, the ZPV has recommended to the judge of the preliminary procedure to follow the current approach and provide anonymity according to Rule 80 (4) (i) rule of regulation and that the ZPV estimates the above required safeguard clauses are strictly necessary, appropriate and proportional at this phase of prosecution.

For Group B, similarly and given the privacy of the application process and the protection of applicant privacy, even for applicants who are not recommended to be accepted as participating victims, The ZPV reportedly recommends to the judge of the preliminary procedure to follow the approach undertaken so far and orders that the names and any identifying information of applicants in Group B be preserved on sides and the public.

Otherwise, on April 29th, the Specialised Prosecutor's Office has handed over a amended indictment against Hashim Thaci, Kadri Veselin, Rexhepi and Jakup Krasniqi.

The prosecution is claiming that the four defendants have committed war crimes even in Gjilan, Budakov and Semtish.

In the published annex concerning crimes allegedly taking place in Semetitish and Budakova, the prosecution has listed war crimes such as arrest and unlawful or arbitrary detention, cruel or inhuman treatment, torture, murder. Meanwhile, as crimes against humanity, he has listed imprisonment, other inhuman acts, torture, murder, the disappearance of people by force and persecution.

And for crimes claiming to take place in Gjilan, as war crimes, he has listed the arrest and illegal or arbitrary ban, cruel or inhuman treatment, torture and murder. While, as crimes against humanity, it has listed imprisonment, other inhumane acts, torture, murder, and persecution.

On November 9th 2020, in their first appearances, Hashim Thaci's Jakup Krasniqi has been declared innocent of the charges placed on them.

Wessel has been declared on November 10th, as has Selimi on November 11th.

The incident against Hashim Thaci, Kadri Veselin, Rexhep Selimi and Jakup Krasniqi is confirmed on October 26, 2020.

According to the prosecution, at least between March 1998 and September 1999, Hashim Thaci, Kadri Veselini, Rexhep Selimi, Jakup Krasniqi and other members of the joint criminal enterprise had the common goal of securing and exercising control over all of Kosovo through methods involving intimidation, mistreatment, violence and the unlawful elimination of those considered opponents.

“Set up these opponents included persons who were, or who were considered to have been: (a) collaborators or forces, officials or state institutions of RFJ, or who (b) otherwise did not support the purposes or methods of the KLA and later QPK, among whom persons linked to the LDK and Serbs, Roma and persons of other nationalities (joinly, non-combatorsors). This common goal included crimes of persecution, imprisonment, arrest and arbitrary or illegal arrest, other inhumane acts, cruel treatment, torture, murder and forced disappearance of persons”, the indictment said.

In addition, Azem Syla, Lahi Brahimaj, Fatmir Limaj, Sylejman Selimi, Rrustem Mustafa, Shukri Buja, Latif Gashi and Sabit Geci are also mentioned.

According to the indictment, the accused along with other KLA leaders contributed to achieving the common goal.

“As an alternative, some or all of these individuals were not members of the joint criminal enterprise, but were used by members of the joint criminal enterprise to commit crimes for the realisation of the common goal (with members of the NKP, jointly members and NKP instruments)”, says the accusation act.
