Thaci's lawyers complained of shortcomings in the reformed indictment. In all, Thaci's defence arguments were that the new indictment has no legal basis and that it must be rejected, as claims fall out/the scope of the timetable over which the court has jurisdiction to judge. Lawyers complain the prosecution has extended that deadline, and the court says it will be taken into account.
The judge finds that Thaci's defence objections to paragraph 93 of this law -- the confirmed and amended Acropolis -- fall within this review and therefore will be taken into account as far as they are concerned with the events of July 1999” -- said the verdict.
The Special Court acknowledges Thaci's concern about the nature and circumstances of the crimes Thaci and others are charged with in the reformed indictment.
However, in light of the fact that the SPS is able to provide further specifications, the pre-procedure judge finds that the new charges in the amended Act will be changed in the manner shown in paragraphs 2729, 36-37 and 42, above”, the decision said.
The special director has instructed the Special Prosecutor's Office to add the author's names to several paragraphs of the new indictment, and has ordered the prosecution that “add the names of the relevant victims to paragraphs 68, 93 and 105 of the Confirmed Actacza modified as shown in paragraphs 36-37, higher”.
The court has also ordered the prosecution to add certain whereabouts of the crime detained in several paragraphs of the new indictment.
