According to them, continuation of the defendant's detention remains necessary and proportional, reports “The Justice Vow”.
“Doubts based and ) although only one would suffice for each of the dangers of Article 41 (6) (b) continue to exist. The accused could still hinder the progress of the procedure primarily by interfering with victims, witnesses and/or their families, and other measures other than detention are unable to ease this”, the prosecution's letter said.
Furthermore, risks of running away and committing further crimes also remain high.
“Probability of their happening has been significantly increased by the close outcome of the case, the closure of the case, the closure of the defence issue, the closure of the evidence procedure, and the appointment of final words. There are no new circumstances, only additional factors fighting in favour of continuing detention”, the prosecution has claimed.
Otherwise, the indictment of Salih Mustaf was confirmed on June 12, 2020, where it was charged with war crimes.
The confirmed “Acuza stipulates that approximately between April 1st 1999 and April 19, 1999, at a detention complex in Zlatko, Kosovo, arbitrary crimes, cruel treatment and torture against at least six people were committed. Also, the indictment says that on a date between April 19, 1999, or about this date, and about the end of April 1999, a detainee” was killed at that location, the Special Court announced through a communiqué.
It becomes known that in the confirmed indictment, Salih Mustafa is charged in the context of various forms of criminal responsibility -- for arbitrary bans, cruel treatment, torture and unlawful murder as war crimes committed in the context of the non-international armed conflict in Kosovo, or in connection with that conflict. / Justice Trust
