Special to Fail, Like Other International Missions Says

Dorajet Imer, university professor in an interview for Online Economy, said the country's justice system managed by the international community could be considered the weakest.

He says even foreign missions have not been able to carry out their work properly because they have not found a local partner ready for co-operation.

On the other hand, he says there may also be elements of experimentation after certain mechanisms and policies have been tried.

I want to believe that each country cannot be built from outside, in the sense of missions, regardless of how important they are. What I mean by that is that it is the mission EULEX or i UNMIK through separate pillars, then the right could not do their job properly unless they find local partners willing to carry out the move. As local partners, the justice system has, respectively, split into many segments and in particular the major political influences that have been exerted towards this segment by individual Kosovo society acts or institutions, naturally that it has created some general climate for the international community or their individual missions not to do their best in Kosovo. We can find that specific missions -- whether the pillars of UNMIK carrier for the justice system -- even EULEX is not doing their job. I'd say that the current situation that we're facing is either the Special Court or our continuing failures in the justice system have exactly originated in these deadlocks that we've had systematically and consistently”.

University professor says Kosovo has lost much of its time and potential, which are hard to regenerate.

We're just in the process of building our state, and we've naturally lost a lot of time in this direction. But besides wasting a lot of time, we've lost a lot of potential that can hardly be regenerationd. We have lost confidence in institutions in several segments. People have also lost little prospect in the sense of supporting the State in the sense of recognition as an impartial institution. So for us this is very important, to have credibility towards institutions and especially toward the institutions of justice. In every measurement of public opinion that is done, the institutions of justice unfortunately come out to be lower on the basis of these issues that we discussed to”.

Politologist Fidan Ukaj said mission EULEX in Kosovo is valued as one of the biggest and most expensive missions of the European Union, but is a failed mission.

Ukaj says the compensation of former EULEX prosecutor Maria Bamieh from Great Britain proves that this mission has not been aimed at establishing crime and corruption in justice.

According to him, this mission has set no good example for local institutions to implement.

“actually mission EULEX in Kosovo is estimated one of the biggest and most expensive missions of the EU, which the European Union has had another country and when viewed by the large number of the mission and the amount shared for law enforcement, we can freely say it has been a failed mission. When I say a failed mission, we take into account the facts and arguments that we have seen and heard. We've heard about how files were put up for certain individuals, how they were taken before and how people were followed by the pressure of politics or certain interests, and that mission was a bad example. The EULEX mission in Kosovo had to be a good example for our institutions, especially justice on how the law should be implemented and crime and corruption pursued. Such a mission has not testified, and in the end, and the compensation to former prosecutor Bamieh proves that there was a mission that had no intention of bringing crime and corruption to justice, but has proved that it is an unstable and failed mission, and it ended. It's not finished as a whole, but his mission has been minimized to the maximum and we have no good example of this mission that our institutions can take as an example that such a practice should be pursued by the mission. A lot of EULEX evidence has been taken by the Special Court -- this politician Ukaj -- considers it another failure. He says the Special Court is also being seen as a next injustice.

This is a next failure. A Special Court should not be formed while European taxpayers paid for such a mission as the mission has been EULEX, mission EULEX has had it on the basis of pursuing high-level crime and corruption. This proves that this mission has not been successful and failed and has only managed to collect files and not judge them. Such a mission until I can also investigate criminals and judge them, then such a mission is deemed a failure, and as a consequence of the failure of the EULEX mission unfortunately, the still-seeing Special Court is an unfair injustice, when we are seeing an unfair judgment of the KLA leaders, on already amended charges, and with an extension that is still a violation of human rights, an entitlement of time terms for judgment”.

According to him, EULEX missions, UNMIK and the Special Court are experiments and failures.

We're actually called Sui Generis, something special. When we say something special, then there are many experiments. We've seen a lot of experiments on different missions starting with him. UNMIK, EULEX, currently recently the Special Court and the situation in Kosovo is not that much has changed from the countries of the region. All these international missions with an extraordinary budget and the situation is close to the countries of the region, we can say we are better but we should be a country of European Union standards. When we say we had it U n NMIC a super-nationalist international organisation of the UN mission and a EULEX, which has been submitted by the EU, we would have to be EU standards. But all these missions have come as an experiment and we can say they have failed”.

He says that even though Kosovo has needed such missions, their seriousness and composition have been failures.

These missions have a positive side, we can't say they were just negative. They have been transitary missions, Kosovo has needed such missions. However, the seriousness of these missions and the composition of these missions has been a failure. We've seen it in UNMIK we've had makeup from around the world. We have seen different cultures and people, and then in EULEX we have seen people who have been retired to the EU and have come because of good payments in Kosovo. However, they have been transitional missions in strengthening our institutions that have already, I believe, also created the experience of self-governing and taking the best practices, if we say there have been good practices from these missions and building stable institutions”.
