Kosovo prosecutor's husband sentenced to 30,000 euros in fine

Bajram Gashi has been sentenced to 30,000 euros in fines, having been charged with exercising influence on his wife's decision-making, prosecutor Ervehe Gashi.

The announcement of the indictment was made Monday at the Constitutional Court in Pristina, by Judge Vesel Ismajli, reports “Justice bet”.

Judge Ishmael said there is a conviction the accused has been forced to pay for the full might of this act.

In addition, the accused Gashi is obliged to pay judicial expenses, as well as the 100-euro judiciary.

Otherwise, Gashi along with Rizan Hoxhaj, who had pleaded guilty, was said to have demanded from Dardan Hoxhaj the 6 thousand-euro sum, promising that if he paid them, the accused Gashi would exercise unjust influence on his wife's decision making, prosecutor Ervehe Gashi.

After accused Rizan Hoxhaj and Dardan Hoxhaj had entered agreements with the prosecution on pleas, accused Rizan Hoxhaj had been sentenced to 28,000 euros in fines, while Dardan Hoxhaj was sentenced to 5 thousand euros.

In the indictment filed by the Special Prosecutor of the Republic of Kosovo (PSRK) on April 13th 2021, Bajram Gashi and Rizan Hoxhaj in co-ordination are said to have carried out the criminal work “The exercise of influence” by Article 431, paragraph 1 concerning Article 31 of the Penal Code.

While, Dardan Hoxhaj was charged with criminal work “The exercise of influence” by Article 431, paragraph 2 of the Criminal Code.

As stated in the indictment, Bajram Gashi and Rizan Hoxhaj during the month of July 2017, with the aim of profiting for themselves, at the office of accused Dardan Hoxhaj on the “Ejup Statovci” in Prizren municipality, had directly sought by Dardan Hoxhaj at 6 thousand euros.

According to the prosecution, this amount had been asked in order that the accused Gashi would exercise unjust influence on his wife's decision-making, prosecutor Ervehe Gashi, who was prosecutor of the case that was under way against accused Dardan at the Constitutional Prosecutor's Office in Prizren, and therefore he would not be charged with all the criminal acts he was being investigated.

Always in accordance with the indictment, defendant Dardan Hoxhaj, lured by the promise of the accused during July 2017, accused Rizan Hoxhaj first hands over the amount of 1000 euros, while on August 22, 2017, he also handed the amount of 5 thousand euros to the accused for the help he had promised he would offer.

While Dardan Hoxhaj was charged by the prosecution that during July and August 2017, in a way and across the way, he had given the money to many of the 6 thousand euros of accused Rizan Hoxhaj to send indictees Bajram Gashi once to prosecutor Ervehe Gashi's husband, who was procuring the case in the criminal procedure under way in order to exercise unjust influence in the prosecutor's decision and accused Dardan Hoxhaj not to be accused of all the criminal acts being investigated.
