KKP continues to oppose Vetting: Initiative that endangers the work of the prosecutorial system

The Kosovo Prosecutorial Council continues to oppose the Vetting process in the judicial and prosecutorial system, even after analyzing the Venice Commission's assessments and proposals.

Kosovo's Prosecutorial Council does not support and will not participate in working groups for any constitutional changes initiative aimed at establishing mechanisms outside the prosecutorial system for verification and integrity checks, as this can be provided within a reasonable time through KPK internal mechanisms, which should be permanent”, the KP response is said.

The KKP estimates that Vetting will cause damage to the prosecutorial system and cause procrastination of procedures, according to them, will prevent citizens from accessing justice.

Kosovo's “Prosecutorial Council, referring to the Venice Commission's response to the concept of the Ministry of Justice for “Vetting” and in spirit the same attitude as expressed by the Venice Commission in its opinion, estimates that the enterprise of uncontacted measures and actions will make an effective damage to the entire prosecutorial system and, therefore, will cause procrastination of procedures, which will inevitably enable citizens of the country to provide an effective approach to justice<3x>

This council has invited the Ministry of Justice to succeed the Vetting, which they believe would endanger the work of the prosecutorial system, jointly advancing reforms.

“Instead of an initiative that risks the prosperity of the prosecutorial system's work and depreciates all the work and investment made in strengthening the prosecutorial system, the Kosovo Prosecutorial Council invites the Ministry of Justice for Intensification of the dynamics of joint work on advancing the initiated reforms, and in addition, to conceive new initiatives with a common goal of further consolidation of the rule of law, promotion and protection of freedoms and the rights of citizens of the country<1x>

The KKP insists it will not support the Vetting, which calls the initiative unnecessary and uncoordinated and tends to interfere with the work and independence of the prosecutorial system.

The Kosovo Prosecutorial Council reconfirms the position and approach, which with this opinion of the Venice Commission has only been reinforced, that addressing the challenges in the prosecutorial system and continuing improvement of performance, should be done through well-ordinated legal initiatives and development policies to further strengthen the internal verification mechanisms, accountability, performance and transparency. The unnecessary, uncoordinated initiatives, with non-real rationalisation, which teach invasive interference in the work and independence of the prosecutorial system will not be backed by the Kosovo Prosecutorial Council”.

The Kosovo Prosecutorial Council says the “proposals and recommendations issued by Venice's Opinion will be confusion in reforms initiated as the draft document of the KPK Strategy, the draft document of prosecutorialisation, as well as the regulatory framework, as well as in the conception of new” initiatives.

With the aim of more effective co-ordination of these initiatives within the institution, the KKP will establish ad-hoc commissions and working groups which in their work we expect continued support with expertise by international partners and donors”.
