The interview of former EULEX prosecutor Miftaraj: The prosecution had to inform the public.

Former EULEX prosecutor in Kosovo Maria Bamieh, after today's conference where he spoke of allegations of corruption he had signaled on this mission, has been invited to interview by the Founding Prosecutor in Pristina. She made the news known herself through a Facebook post. While, after media interest, the prosecution stated that Bamieh was invited for an interview because it was impossible to secure her statement in the past years.

In this regard, Ehat Miftaraj from the Kosovo Institute for Justice (IKD) says the prosecution had to inform the public in order to avoid prejudice.

“As if, a prosecutor who is governed on sound principles in the case of handing over the invitation would have to inform the public in the right way to avoid prejudices regarding this case”, Miftaraj said in pronomation for Telegrafi.

According to him, given the fact that prosecutor Bamieh is a beacon, the prosecution should have increased caution in relation to the same.

This to preserve its rights in relation to its status as signals to the exposure of corrupt relatives to EULEX at the time when there was exclusive competence in the fields of fighting organised crime and high-level corruption in Kosovo”.

At today's conference in Pristina, former prosecutor Bamieh showed how he had uncovered allegations of corruption in the case of Ilir Toliaj, former Secretary of the Health Ministry. She showed how by wiretaps she had learned that EULEX Judge Francesco Florit met with Tolaj's mediators, when he was in prison, to eliminate the case in exchange for a payment.

But, following investigations conducted by the chief Kosovo prosecutor's office, it turned out that former EULEX judge Francesco Florit had not done any work during his duties.

Linked to this, Miftaraj voiced doubts about the impact of the process after, as he said, Gabriele Meucci, chief of EULEX's mission at the time the case has been initiated against Bamieh, has had close cases with Alexander Lumez, chief state prosecutor at the time.

“The case in question against prosecutor Bamieh was initiated sometime in 2015, at the time that EULEX Mission chief Gabriele Meucci, one of the most controversial figures in this mission from its formation until today, which had close reports with Alexander Lumez”, Miftaraj said.

As if, the initiative of this case was initiated by the chief state prosecutor's office shortly after Alexander Lumez was taken over by the chief state prosecutor. We talk about a time when information about corruptness within this mission had appeared in public, where allegations were that prosecutors, judges and other senior officials within the Euex” mission.

As a result of these allegations, Miftaraj said that this mission was also the target of investigations by European Union audiences.

“Viti 2014 and 2015 are dark years for the EULEX mission, where this mission had emerged from its role, and was included in the inconsistent processes of that time that were held in Kosovo's prosecutorial system, where the key role no doubt had been the Meucci”, he claimed.

However, Miftaraj adds that today's invitation to the Prosecution is only an act of an investigative procedure initiated in 2015, and “which has been suspended to prevent passage of the investigation as the Criminal Procedure Code defines, taking on the basis that prosecutor Bamieh lives outside the Republic of Kosovo”.

Otherwise, the former prosecutor Bamieh's accusations have also reacted to EULEX's office, saying it has repeated unfounded accusations, gossips and slanders.

At today's press conference, we've heard Maria Bamieh repeat accusations, gossip and unfounded gossip. Bamieh never presented a new test”, said in their response.
