Everything that happened on the first day of trial against Dardan Krivaks and Arber Sejdiu

For Dardan Krivacea and Arben Sejdiu charged with the 18-year-old murder, Marigona Osmani today has been held initial hearings near the Foundation Court in Ferizaj.

The accused, Krivaca, who is in charge of criminal work “raped” and “severe murder” was quietly protected at this stage of this trial process, while the other accused, Sejdiu, was acquitted of charging him with criminal work “severe murder and of helping him commit violation<5>.

At the Ferizaj Foundation Court Hall with a large number of Special Unit forces brought the two defendants in. The accused, Dardan Krivaca, was wearing his bulletproof vest along with a large escort of police officers.

The whole process was closely conveyed by parents of the deceased, Marigona Osmani, and other family members.

After reading the indictment, the chairman of the court, Sahit Krasniqi asked the accused, Dardan Krivaca, if he understood the indictment.

Krivaca was seen crying.

I'm not doing anything anymore...

Krasniqi: Have you understood the indictment you do not need to cry...

Krivaca: I don't know...

Krasniqi: Do you need the state prosecutor to give clarification?

Krivaca: No.

And the other accused, Arben Sejdiu, declared he understood the indictment he was charged with.

And when the accused, Dardan Krivaca, was asked about guilt, he said he did not say he is innocent, but would be quietly protected at this stage of criminal procedure.

I'm not saying I'm innocent. I don't know.

The other accused, Arber Sejdiu, was acquitted.

 I can feel myself innocent”, he said.

The case attorney, Valdet Avdiu, read a piece of the charge.

 The defendant, Dardan Krivaca on August 21st, 2021 in his residence on St. Rhamadan Rexhepi in Ferizaj without her consent forced the deceased, Marigona Osmani to engage in sexual relations that is conveyed to torture in a way that she originally had sexual relations in the living room. After performing the same sexual act, he takes it to the bathroom. From there he is forced into the bedroom, but over time because of his serious health condition as a result of the violence exercised, he loses his ability... And where, on two occasions, they have sexual intercourse in the evening and then naked and then takes it to the bathroom and where they notice injuries for the crime of rape... The defendant, Arben Sejdiu, on August 21, 2021, deliberately assists them in the head of the criminal offence '%s' so that they first contact the phone and meet in the city and then together return to the residence of the defendant Arber as he arrives, knowing that Dardan is now violating the late Marigona Osmani by willing”, said in the indictment.

Avdiu said the accused had attempted to erase video footage of cameras that were located in the apartment where crime had occurred.

 The defendants, Dardan Krivaca and Arber Sejdiu, on August 22nd 2021 at the defendant's residence, Dardan Krivaca on St. Rhamadan Rexhepi in Ferizaj on purpose and co-ordination with the goal of hiding criminal acts deprive the deceased of life now, Marigona Osmani, with whom the first defendant was in extramarital relations. After the trial hearing ended, the defence of the Osmani family, Gazmend Rexhepi said the condition of the deceased's family, Marigona Osmani, is serious.

 “As you can see, we're going with a trial elaboration and we're going to see the case to the end, in all likelihood... They yourself saw them as guilty statements, as innocent as their situation is the same, in serious condition“, Rexhepi said.

Before the trial of Dardan Krivaqias and Arber Sejdiu began, activists of “Progressive and Feminist Action” protested before the Constitutional Court's facility in Ferizaj, where they requested fair judicial process.

The founding prosecutor at Ferizaj last month announced that he has filed charges against defendants Dardan Krivaca and Arber Sejdiu.

According to the prosecution indictment, dated August 22nd 2021, defendants Dardan Krivaca and Arber Sejdiu deliberately and in co-ordination now deprive the late Marigona Osmani of life, of what in co-ordination conducts criminal work “heavy murder”.

Dardan Krivaca was arrested on August 25, 2021, while Arber Sejdiu was arrested on August 24, 2021.
