Konjufca has called these sentences too high, while adding that she believes the appeal will bring down this sentence.
“I believe the appeal will bring down this very high sentence for Mr Haradinaj and Mr. Gucati”, he said at RTK.
The Specialised Chambers convicted Hysni Gucatin and Nasim Haradinaj of obstructing justice management, condemning them to four and a half years in prison and with a 100-euro fine. The sentence will also account for the time spent in detention. They are in custody since September 2020.
“On behalf of the people of Kosovo, the court was convicted of: obstructing official persons in carrying out official actions through serious threats, obstructing official persons in carrying out official tasks through participation in joint actions of a group, fearing according to criminal procedure, violating the secret of the procedure through unauthorized intelligence of classified information issued in official procedures, violating the secrecy of unauthorised intelligence procedure of the identity and personal data of protected witnesses”, Judge Charles Smith III said.
Gucati and Haradinaj were acquitted of prosecution of revenge.
The specialised prosecutor, Jack Smith, said Gucati and Haradinaj have been convicted of their crimes, “following a transparent, careful and fair” judgment.
The Specialised Prosecutor's Office will strongly continue investigating and prosecuting all acts of witness intimidation, revenge against witnesses or obstruction of justice... If you try to intimidate or avenge the witnesses of this court, I will do everything in my power and make sure you are brought to justice”, he said.
Nasim Haradinaj and Hysni Gucati's defence teams confirmed to reporters that they will appeal the punishment act for the two indictees, pronounced 18 May by the Specialised Chambers in The Hague.
