genocide indictment against Serbia is deemed a difficult process

Only in April of 99 did Serbian military and police forces, according to data, kill over 4,000 Albanian civilians. But that is not all. During the war, Serbian forces executed over 13 thousand Albanians, committed over 400 massacres, Serbian police and soldiers violated over 20,000 women, burned and destroyed almost the entire infrastructure.

There are numerous facts and evidence in this. Even for collecting as many material as they show Serbia has committed genocide in Kosovo, the Justice Ministry has even opened an electronic address in which citizens can send material that facts Serbian crimes. For that, the ministry says they are constantly accepting such material.

A first draft of the Law for the Institute is finalised this week, we believe that in the next week it will be in preliminary public consultations, and sometime in June we believe to have the law voted in Government and after the law passes regular approval procedures even in the Assembly will be activated. And then the institute is competent to systemize this data”, it stressed for RTK at Genc Nimoni, chief of the cabinet of Minister Albulen Haxhiu.

The collection of these materials aims in the event Republic institutions sue Serbia for genocide, be documented and verified. But from the organisation “Arise” say such an indictment is difficult to make.

Whatever institutions have had to do that have not been done so far and I think it's too late, we should at least have gathered the crimes that Serbia committed in Kosovo. Likewise, the damage caused him, valuable and appropriate, and everything that happened. So they were counted. These things aren't included in our institutions, so it's very difficult to draw up a lawsuit on this case”, it's the Arton Demhayan of the organisation “Arise” for RTK.

But as far as Kosovo has the right to file charges against Serbia for genocide in a judicial sense. The answer comes from the Kosovo Institute for Justice.

“in a judicial sense we consider that for the moment Kosovo is at hand, the preamble of such a lawsuit is impossible for itself the fact that Kosovo is not part of the UN, and with that is not even part of the JND statute. Given these obstacles, then addressing this indictment we are afraid that it would be declared unacceptable once it is handed over to JND”, Yll Zekij of IKD stressed.

According to Zekij, any movement in this direction without agreement with the international factor would be against productive Kosovo, rather than being treated as an indictment.
