Cardiologists to Continue Strikes Against MS Decision

Invasive Cardiologists at the University Clinical Centre in Kosovo are refusing to return to the Cardiology Clinic, rejecting the Health Ministry's decision to change the KKUK statute, which was signed early April.

Invasive Cardiologists are currently awaiting the Constitutional Court's decision to impose the interim measure of the MS decision, which they submitted to Constitutional last week.

The legal representative of these health professionals, Florim Shefqeti, says that in the new statute issued by the Ministry of Health, many shortcomings and violations have been recorded.

“The minister of Health has issued an act that he has called a statute, and through which it is claimed to be fulfilled-changing the statute, which in a judicial way has many shortcomings and the first one that can be fulfilled by statute can be done by annexes or the new statute issued. Law tradition does not recognise such forms, but since we have analysed the issue of how it originated as a procedure, we have found this to be done in accelerated and bypassing and violating constitutional legal rights, but also with government regulations and administrative guidelines that determine the binding aspect of holding preliminary consultations with the subjects that are fortunately affected. In concrete cases, invasive surgeons have never consulted this document, either called a statute or its contents, nor with the need to join, Shefqeti stressed.

According to Shefqeti, the change of the statute in question that unites the invasive cardiology department with that of the Cardiology Clinic, it has violated the law against discrimination, since the clinic's doctors have also been violated by the work contract.

The lawyer stresses that the reason for this union of these two clinics is aimed at returning waiting lists and recommending patients for treatment in private hospitals, but also abroad.

These all have working contracts with the Invasive Clinic, and now this week the second attempt has started by offering task makers decisions, for example, to act the task of the head of the department's office and this is to replace it with mandatory persons for those who have done this form, and all this war on invasive cardiologists is not new from September 2021, so that some of them have initiated dissertial procedures with reasoning that have told us the truth and that the list of hosts has said they have also issued the letters that have been planning to break down the list of time for decomposition of this year 2021, so that some of them have been initiated in response to the situation and that we do not know what is in order to get back to the local procedures and what is going on and what is going on and what is going on.

The Shefqet for Kosova Prees, also states that invasive cardiologists are determined not to comply with this decision.

He indicated that last week they submitted their request to the Constitutional Court to impose temporary measures on this statute.

“E we have submitted the application to the Constitutional Court, where we have requested temporary measures besides the Health Law, as well as the statute and regulation of government work and regulation for minimum standards in public consulting processes and administrative guidelines for drafting norms and many other documents determine that this form of action has so many violations that it will not remain. The second of invasive cardiologists are unique and determined that they will not apply such a form, they are always in the negotiations we have had ready to create a heart hospital where they will function as separate departments because even the functioning in practice is such“, Shefqeti stressed.

The legal representative of invasive cardiologists, Florim Shefqeti, warned strikes on the part of these health professionals until the achievement of cancellation and changing of the statute that is directly affecting invasive cardiology.

“There will again be strikes, the strike will continue until the achievement of goals, but we soon expect the Constitutional Court to set temporary measures and so that I can suspend the implementation of this decision and this statute and then sit down and talk about forms and organisational modalities because it is required by regulations and laws... They expect the Constitutional Court to declare it illegal and anti-unconstitutional in the manner that in the case of Kamenica, who has judged it, so we believe that the form that has been done is illegal and cannot stand as such, said the legal representative of invasive cardiologists.

Contrary to this decision, invasive CKUK cardiologists held an hour-long strike last week.

Thirteen invasive cardiologists have also turned to Kosovo Prime Minister Albin Kurti, with a request to annul the decision by Minister of Health Rifat Latifi, for changing the statute of Kosovo's Clinical and University Centre.

With the resolution of this statute completed, the invasive cardiological service has been restored to the clinic of Cardiology, as the same had been moved to the Cardiosurgia Clinic in 2016.

Kosova Preress has tried to get an answer from the Ministry of Health as well as the University Clinical Hospital Service of Kosovo on charges and demands of invasive cardiologists, but both sides have not returned.
