The fine given him contains 180 daily units of 50 francs, under the verdict, which the Cyril District Court has released Friday.
At the same time, he will be revoted on the condition of a 14-month prison sentence pronounced in August 2019, writes Sda.ch. Pensioner from Kosovo, this sentence has to be maintained effectively. His previous parole sentence had been pronounced for the incident when he had fired a gun to the ground at the Langstrasse of Cyril to end a quarrel.
While the incident, which was processed Thursday, included an attack on a Denner employee, albinfo.ch conveys. The latter had stopped the pensioner by February 16, 2021, shortly before leaving the store: He had suspected that he had stolen a bottle of water when he bought a kilo of pears.
But the pensioner did not want to show his bag. Moreover, he had picked up his cane with both hands, lifted it up, and struck the employee with all force, once in the head and once in hand, described the prosecutor's case in her indictment.
The prosecutor has described the event as a simple attack with dangerous objects. She has been demanding that the prison sentence be implemented for 22 months. Within the sentence, it included the criminal record of 2019.
Lawyers Claim Misunderstanding
On the other hand, the accused in court has stressed that the employee has only removed him by stick and has not hit him at all.
While Kosovo's lawyer has said that his client, who has Parkinson's disease, is weak not only because of his age and unstable standing up. If he had really shaken his cane while holding his purse and a bag on his shoulders, he would have fallen to the ground. So it can't even be a shock. The pensioner's defender has spoken of a serious and total “misunderstanding. The 71-year-old had wrongly assumed he was in a threatening situation.
Threats to Family
At the time of the incident against his son, a criminal prosecution for murder was under way. In December 2021, the Supreme Court had sentenced the boy to 16.5 years in prison. He had fired weapons at a gas station in the direction of an opposing group and had fired a 30-year-old opponent.
The lawyer stated that threats were received at the time from the victim's family. The 71-year-old was under emotional pressure, the fear of revenge was great. So this “came up completely absurdly”.
The defender has praised the attack with a staff as a simple attack. He asked the court to pronounce his client a 700 franc fine or a parole fine.
The decision is not yet complete. It can be appealed to the Supreme Court of Cyril Canton.
