Prosecutor Wants to Sentence of Two O'S ex-experts DSP charged with corruption

The Constitutional Court in Pristina, on December 20, 2021, had declared a free trial against the two former exhibitors and Procuratory Organisation (OSHP), Durim Ramadani and Zecir Fetosi charged with the criminal work of “Kestum use of official office”.

And the owner of the firm NTP “Friends”, Armend Selimi, who was charged with them, was found guilty of “fraud” and was sentenced to six months in prison, while being acquitted of the prosecution of “Forging” documents.

According to Apel's college reference judge, Aferdita Bytyqi, against this plea has filed a plea against the Founding Prosecutor in Pristina, due to the misconception of the actual situation, violation of criminal law and the conviction, with the proposal that the complaint be amended, the accused who have been acquitted of charges be convicted, or otherwise the guilty plea be annulled and the case returned to restoration.

Bytyqi also indicated that the complaint against this act has also filed the defender of accused Armend Selimi, lawyer Florent Latifaj.

The latter has filed the complaint because of the mistaken confirmation of the actual situation, the substantial violation of the penal procedure's provisions and violation of criminal law, with reasoning that the complaining act of judgment be changed, and its defender be released from the pronounced sentence or conviction be annulled and the case returned to restoration.

In addition, Bytyqi stated that the defender of the accused Zecir Fetosti, lawyer Rame Gashi, has exercised answers to the prosecution's complaint, proposing to the court that such a complaint be refused as unsubstantiated, while the plea of the legal part to protect him is proven.

She said the Appeals Prosecutor's Office in her letter has proposed that the prosecution's request be approved, while the request of accused Armend Selimi, attorney Florent Latifaj, be denied as unfounded.

Following these demands, lawyers Latifaj and Gashi have stood by today, proposing that the same be approved by the Court of Appeals.

Otherwise, according to the indictment set up in April 2016 by Pristina Foundation Pristina Prosecutor, it is said that Armend Selimi in the quality of the firm's owner NTP “Friends” in Pristina, from 2013 to July 2014, in order to bring itself illegal wealth, has forged the document he wanted to win a tender.

Wanting to import medical products and provide authorizations from the Kosovo Agency for Products and Medicines (AKPPM), it is said to have forged certificates handed over to the AKPPM.

In this case, he is said to have committed the criminal act of “fraud” and that of “Forging” documents.

While, Durim Ramadani and Zecir Fetoosti indictment says that by misusing office or official authority and in order to bring rich benefits to themselves, they have failed to fulfill their official duties.

They reportedly have not done their work in accordance with the law, in the quality of experts engaged by the Procuratory Organisation, regarding the tender for which Armend Selimi allegedly forged the documents.

According to the prosecution, they had misused their position in terms of the tender for “Forum with extenuative material” from the essential list from the Health Ministry. The same ones according to the indictment had been aware that the authorization issued by the “Johnson &Friends” in London was forged and that defendant Armend Selimi represented this authorization.

On the basis of this, they were said to have known that these documents were forged and thought and calculated that the file was original.

In this form, according to the indictment, the company “Friends” has managed to win the tender from the Ministry of Health.
