The Commission of the Year deal with UBT college that can activate the investigation

The annual municipality has avoided the legal procedures of competition to favour UBT college to regulate municipal space exploitation for a period of several years.

The deal is signed between the UBT sector, which is also the owner, Edmond Hajrizi, and the deputy head of the Commission of the Year, Hasan Aliu.

Initiation of such activity has been made by avoiding, the authority of the Municipal Assembly, which is the institution that must give consent to such an initiative, and after finalisation, to approve the document.

The municipal executive has not sent a seed to the Assembly for approval of the decision to draft the Zone Map, as the Law on Space Planning defines the Law for Local Self-Government.

The equally big violation is also about the fact that the municipality has not brought this initiative into competition, according to the law, but has been binding favourable agreements.

The approval of the Zone Map is a document that the Community should approve, as the same stems from NR .04 /L-174 for Space Planning. And this law has detailed all steps on how to proceed in such a case.

Article 10 of this law, speaks of the responsibility of the Communist Assembly in Space Planning. “2.1 The municipal framework is responsible for: the approval of the proposal for the draft of the Municipal Development Plan, the Communist Zone Map, as well as detailed regulatory plans”. This point was avoided by the Communists.

Under the document signed by parties, the purpose of this agreement is to provide a framework of co-operation within which The UBT and the Committee of the Year jointly draw up the Municipal Zone Map and the Environmental Strategic Rating Report for the Community of the Year.

The parties agree that the agreement also contains financial obligations. The total cost of the project is 145 thousand euros. Of this cost of 70 thousand euros (48.3% of the total sum) will be covered by the municipality of the Year. While the rest 75 thousand euros will be covered by UBT

What's a Space Map?

The signing is a means to enable municipalities to regulate the exploitation and development of land for the entire territory of the municipality. This means regulation of resources and environment, infrastructure and support services, with the aim of ensuring spatial, physical, economic, social and environmental development, health, and welfare of urban and rural communities. The representation context in Kosovo under the legislation defines two key things:

Rules for exploitation and development that provide development opportunities and restrictions for citizens, owners, investors and government institutions.

Implementation of capital projects at the responsibility of the ruling central and local authorities, in line with the budget and timetable of spatial planning documents.

The zone works with the precise division of territory in functional areas. For each area, based on a map of planned land exploitation, it defines land exploitation, developmental conditions and protection measures for the planned period of development (Nani 6, UA MMPH-NR. 24/2015). The zone is based on the concept of an area- a set of developmental conditions. The conditions set out for a certain area apply to each area where that area is geographically positioned.

Kosovo Space Plan (PHK) and Kosovo Space Map ( HZCos is the main documentation of the space planning sector stemming from the Space Planning Law. With the Law amended in 2013, Map Zone as a document becomes part of the spatial planning system at both levels of governance. According to these changes is the Ministry of Economy and Environment at the central level and relevant directors from the local level of governance, responsible for producing these important sectoral documents in certain time terms. /M.
